Nusron Admits Many ATR/BPN Employees Are Entangled In The Law Due To Land Certification In The River Sempadan

JAKARTA - Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Nusron Wahid admitted that many employees within his ministry were caught in legal cases because they certified the land above the river border to the reservoir.

This was conveyed by Nusron after a meeting with Deputy Minister of Public Works (PU) Diana Kusumastuti at the Ministry of Public Works office, Jakarta, Wednesday, October 29.

"The large number of ATR/BPN people, officers who were later subject to legal cases due to certifying the land above the river border, reservoirs, lakes, and so on," said Nusron.

According to him, this was due to differences in understanding of the use of space.

There are people who mean river border is state land, so that anyone can take advantage of it as long as the state gives the rights in the form of land certificates.

On the other hand, the state understands that rivers and river boundaries are the wealth of a state controlled by the state.

"This is biased, so that many people from the Ministry of ATR/BPN are subject to legal cases on this matter," he said.

Lebih lanjut, Nusron tak menampik banyak sertifikat tanah yang terbit dan bangunan berdiri di atas sempadan sungai hingga waduk Jabodetabek.

"Nanti kami akan cek masih ada berapa tanah yang disertifikatkan di situ, kami batalkan karena itu di atas sempadan sungai. Akan kami cek ada berapa bangunan gedung, kami minta pemda untuk membatalkan," kata dia.

Apalagi berdasarkan peraturan, sempadan sungai merupakan ruang gerak air, sehingga tidak boleh ada bangunan di atasnya.

Furthermore, Nusron did not deny that many land certificates were issued and buildings were standing on the river border to the Jabodetabek reservoir.

"Later we will check how much land is certified there, we cancel it because it is above the river border. We will check how many buildings there are, we ask the local government to cancel it," he said.

Moreover, based on regulations, the river border is a space for water to move, so there should not be a building on it.
