JAKARTA Law expert at Muhammadiyah University Surabaya, Satria Unggul Wicaksana assessed that the tragedy of the collapse of the prayer room at the Al Khoziny Islamic Boarding School, Sidoarjo, East Java, which killed dozens of people had serious legal consequences.
"This problem can be directly processed criminally or civilly without having to wait for a complaint. Cases like this include general offenses. This means that the police can immediately conduct an investigation without waiting for a report from the victim or family," he said, Sunday, October 12, 2025.
He explained that criminally, leaders or owners of Islamic boarding schools, contractors, and consultant planners and supervisors could be charged with Articles 359 and 360 of the Criminal Code regarding negligence in causing death and injuries to become the main threat, plus the Building Law.
"Especially if the construction is carried out without a permit or does not meet safety standards, then the pesantren leadership can be considered legally negligent. This is not just an administrative violation, but can lead to a crime," added Satria.
"In addition to implementing construction, consultant planners and supervisors can also be held accountable if proven negligent in planning and monitoring the quality of the work," he continued.

Meanwhile, in the civil realm, the lawsuit includes material compensation such as medical and funeral expenses, to immaterial punishment for the mental suffering that is borne. This can be done referring to Article 1365 of the Civil Code concerning Acts of Law Opposite (PMH).
Satria emphasized that this case must be a strong warning to all parties. Therefore, local governments and religious institutions are encouraged to tighten supervision of every development project.
