Only 15 Of The 109 Mining Companies Place Reclamation Guarantee Funds

JAKARTA - The Ministry of Energy and Mineral Resources (ESDM) through the Director General of Mineral and Coal of the Ministry of Energy and Mineral Resources Tri Winarno revealed that so far only 10 to 15 companies have fulfilled the obligation to place reclamation guarantee funds.

Just so you know, recently the Directorate General of Mineral and Coal frozen 190 mineral and coal mining business permits (IUP) because they did not place reclamation and post-mining guarantee funds.

"Not much, maybe around 10-15 like that," said Tri, Thursday, October 9.

Tri added, after paying the reclamation guarantee, his party has also returned the IUP so that the company can operate again.

I admitted that he did not know the exact reason why 190 companies were reluctant to pay reclamation guarantees. In fact, the placement of a number of funds in government-owned banks is a mandatory requirement when carrying out mining activities.

"What is clear must be obedient, right. If the reason is why don't you know," explained Tri.

Tri said that previously his party had also sent warning letters three times to these companies. After the letter was sent, the Directorate General of the Ministry of Energy and Mineral Resources then stopped the company's operations for 60 days.

"If we don't take care of it, we will revoke it. But the obligation for post-mining reclamation remains attached to it (mining company)," said Tri.

Sebelumnya, Ditjen Minerba membekukan kegiatan operasional 190 perusahaan tambang batu bara dan mineral yang tidak memberikan jaminan reklamasi pascatambang.

Pembekuan 190 perusahaan ini tertuang dalam surat Ditjen Mineral dan Batu Bara (Minerba) Kementerian ESDM dengan Nomor T-1533/MB.07/DJB.T/2025 dan ditandatangani pada 18 September 2025.

Dalam surat tersebut disebutkan jika sanksi penghentian sementara kegiatan pertambangan secara otomatis batal jika perusahaan telah mendapat surat penetapan dan menempatkan jaminan reklamasi sampai dengan 2025.

Previously, the Directorate General of Mineral and Coal had frozen the operational activities of 190 coal and mineral mining companies that did not provide post-mining reclamation guarantees.

The freezing of 190 companies was stated in a letter from the Directorate General of Mineral and Coal (Minerba) of the Ministry of Energy and Mineral Resources with Number T-1533/MB.07/DJB.T/2025 and signed on September 18, 2025.

The letter stated that the temporary suspension of mining activities would automatically be canceled if the company had received a letter of stipulation and placed a reclamation guarantee until 2025.
