Synergy Between The Police And The Prosecutor's Office Is Proposed Through The Dual Control Justice System

JAKARTA Senior Political Observer Boni Hargens proposed concrete steps to reform the national legal system during the administration of President Prabowo Subianto and Vice President Gibran Rakabuming Raka. He encouraged systemic innovation through the implementation of a two-layer legal control system or dual control justice system as an effort to strengthen the balance of roles between the Police (Polri) and the Prosecutor's Office.

"I propose a two-layer legal monitoring system as a rational solution to reorganize the balance between the Police and the Prosecutor's Office, where the National Police remains the executor of the investigation and the Prosecutor's Office as a judicial controller, so that there is a mutually responsible mechanism," said Boni Hargens in Jakarta, Tuesday, October 7.

According to Boni, this bilayer system offers a clearer and more measurable division of roles. In this concept, the National Police serves as the main executor of the investigation according to the mandate of the Criminal Procedure Code, with full authority in collecting evidence and determining suspects. Meanwhile, the Prosecutor's Office acts as a formal controller who ensures completeness and legality of case files before entering the prosecution stage.

With this model, said Boni, the P-19 and P-21 functions will again be meaningful because the supervision is running in two directions. He assessed that the two-layer system was not a form of competition between institutions, but instead strengthened the mutual control mechanism.

"With a clear separation of roles, each institution can focus on its core function without overlapping counterproductive authorities," he said.

Boni assessed that the two-layer legal control system would bring a number of advantages, ranging from the separation of more measurable functions, improving the quality of case files, to strengthening public trust in law enforcement agencies.

In addition, this system is believed to reduce the potential for abuse of authority and create efficiency in the criminal justice process.

"The Prosecutor's Office does not take over the investigation function, but strengthens its role as a *quality controller* which ensures that every case that goes to court has met strict proof standards," he explained.

In the context of legal reforms in the Prabowo-Gibran era, Boni encouraged a more comprehensive approach and focused on strengthening institutional morals. According to him, legal reform is not just institutional restructuring, but rather an effort to strengthen the values of integrity and accountability in every institution.

The National Police has become a real example of legal institutions that dare to be monitored and are ready to be criticized. Models like this must be replicated to other institutions in order to create a healthy and sustainable law enforcement ecosystem," said Boni.

He emphasized that true legal reforms must be based on three main pillars: strengthening institutional morals, balance of authority, and transparency across institutions. In addition, continuous collaboration between legal institutions is needed without eliminating the supervisory function of each other.

"This nation needs law institutions that supervise each other, not eliminating each other. Legal reforms are not about expanding power, but expanding moral responsibility," he stressed.

Boni closed her statement by calling on all legal institutions to strengthen their commitment to transparency and collaboration across institutions.

"True legal reforms are not measured by how much authority is added, but from how much moral responsibility is carried out consistently," he concluded.
