The Ministry Becomes BP BUMN, What Is The Fate Of The Deputy Minister?

JAKARTA - The status of the Ministry of SOEs has officially changed to the Regulation Agency (BP) in line with the ratification of the Draft Law (RUU) on the Fourth Amendment to Law Number 19 of 2003 concerning State-Owned Enterprises (BUMN).

Then what will happen to the deputy minister?

Deputy Minister of SOEs Kartika Wirdjoatmodjo admitted that he did not know the direction of his assignment after the Ministry of SOEs officially transformed into BP BUMN.

Currently, he said he was still waiting for instructions from the President of the Republic of Indonesia regarding his position after the ministry turned into an agency.

For your information, the Ministry of SOEs after being abandoned by Erick Thohir was led by Dony Oskaria as Acting Minister of SOEs. Then there are two deputy ministers, namely Kartika Wirjoatmodjo and Aminuddin Ma'ruf.

"We don't know yet. We just follow the orders," he said, quoted Monday, October 6.

Regarding employees, Tiko, as he is familiarly called, said that he would automatically enter the BP BUMN. However, officials from the Ministry of SOEs are still waiting for a decision from President Prabowo Subianto.

"If the BUMN employee immediately becomes an employee of the Agency later. But if the officials we don't know yet. That will be the president's authority to regulate again," he explained.

When asked if there would be employee efficiency following changes in institutional structure, Tiko could not confirm yet.

"I don't know yet," he said.

Previously, PANRB Minister Rini Widyantini representing President Prabowo Subianto said the government approved the BUMN Bill to be enacted into law (UU).

Rini explained that the amendment to the BUMN Law was born from the urgency of affirming the function of regulators and operators, and strengthening governance, and providing legal certainty of the position of BUMN in state administration.

Furthermore, Rini said that the change was also intended so that SOEs would become a catalyst for development as well as an agent for inclusive and sustainable economic transformation.

"The fourth amendment to Law Number 19 of 2003 concerning SOEs is not just an administrative revision, raising a strategic step to strengthen the position of BUMN as a national economic driver as well as a welfare-oriented state policy instrument," said Rini when conveying the government's final view at the 6th Plenary Meeting, at the DPR Building, Jakarta, Thursday, October 2.

Rini said the main material in the BUMN Bill that was ratified included the institutional transformation of the Ministry of SOEs into the BUMN Regulation Agency (BP BUMN).

"Institutional transformation from the Ministry of State-Owned Enterprises to the State-Owned Enterprises Regulation Agency, which is abbreviated as BP BUMN," he said.

In addition, the BUMN Bill also regulates the transition period for the concurrent positions of ministers and deputy ministers in BUMN no later than two years after the decision of the Constitutional Court was read.

Then, it also regulates that BUMN employees have the opportunity to occupy the position of directors, board of commissioners, and other managerial positions by prioritizing gender equality.

Then, regulating taxation on transactions involving Indonesian Danantara, investment holding, operational holding, BUMN entities, and third parties will be further regulated through government regulations.

Furthermore, continued Rini, the Supreme Audit Agency (BPK) remains authorized to conduct an examination of SOEs in accordance with statutory regulations.

Rini added that employees of the Ministry of SOEs will also be transferred to BP BUMN employees.

"Institutional transformation, affirmation of the position of organs and employees, dividend regulation, taxation, and BP BUMN authority are efforts to create clear governance between regulators and operators," he said.
