Smoking In Non-Smoking Areas In Jakarta Will Be Fined IDR 250 Thousand To IDR 10 Million
JAKARTA - The Special Committee (Pansus) for Smoke-Free Areas (KTR) of the Jakarta Regional People's Representative Council (DPRD) is finalizing the Draft Regional Regulation (Raperda) on KTR. This new regulation includes significant fines for smokers who violate prohibited areas.
The draft Raperda KTR stipulates strict sanctions for individuals who intentionally smoke in prohibited areas.
Article 17 of the Raperda stipulates that violators will be subject to an administrative sanction in the form of a fine of IDR250,000. This sanction is cumulative and can be imposed repeatedly depending on the number of violations committed.
Dwi Rio Sambodo, a member of the Special Committee for KTR of the Jakarta DPRD, stated that this fine could be increased to a maximum amount.
"Sanctions ranging from IDR250,000 to IDR10 million are the final enforcement tool," Rio told reporters on Monday (October 6).
Emphasize Fairness and Prioritize Clear KTR Facilities
Although fines are intended to provide a deterrent effect, Rio emphasized that the Jakarta Provincial Government must prioritize fairness when imposing sanctions. The main priority must be the provision of adequate facilities.
"The main priority must be the provision of clear KTR facilities, such as signage and restricted smoking zones," said Rio.
The Special Committee also recommended the need for dialogue with stakeholders, including business actors and associations, before the Draft Regional Regulation is ratified. This dialogue is crucial to minimize legal loopholes.
11 Zones Designated as Smoke-Free Areas
The Draft Regional Regulation (Raperda) designates at least 11 areas as Smoke-Free Areas (KTR), including:
Healthcare facilities
Teaching and learning areas
Children's play areas
Places of worship
Public transportation
Sports facilities
Workplaces
Public places
Nightlife venues
Integrated public spaces
Certain places that issue crowd permits
Further provisions regarding KTRs in integrated public spaces and crowded places will be regulated through a gubernatorial regulation.
