DPR Sahkan UU BUMN, Puan: BP BUMN Harus Berperan Besar-besarnya Untuk Kesejahteraan Rakyat

JAKARTA - The DPR passed the State-Owned Enterprises Law (RUU BUMN) at the DPR Plenary Meeting today. DPR Speaker Puan Maharani hopes that this law can bring positive changes to BUMN governance, especially for the welfare of the people.

The SOE Law, which was recently passed, regulates the change of the Ministry of SOEs to the Budgeting Agency for Owned Enterprises (BP BUMN).

"The SOE Law has been ratified, later the SOEs will turn into BP BUMN, hopefully the implementation in the field can indeed go well," said Puan at the DPR building, Senayan, Jakarta, Thursday, October 2.

According to Puan, the spirit of this change is in line with President Prabowo Subianto's direction, namely for SOEs to carry out their role optimally for the benefit of the people, as mandated by the constitution.

"As conveyed by the President's spirit that SOEs as state-owned enterprises, must indeed function and play a role as much as possible in accordance with Article 33 (UUD 1945) is for all Indonesian people," said Puan.

Nevertheless, Puan reminded the importance of institutional structuring so that there is no overlap between the function of regulators and operators. According to him, this is crucial so that SOEs can work more effectively.

"Which has now been withdrawn to Danantara. So don't let there be a high overlap between regulators and operators," said Puan.

Puan also hopes that with a new legal umbrella, the technical implementation of SOEs can be carried out immediately. In addition, said Puan, so that SOEs have a real impact on the wider community.

"So this improvement, of course, God willing, will bring benefits to Indonesia's future. After this there will be changes to the law, of course there will be a legal umbrella to be implemented or followed up in the field," he concluded.

The following are 12 points of amendment to the BUMN Law which has been ratified by the DPR plenary meeting into law:

1. Arrangements related to institutions that carry out government duties in the BUMN sector with a nomenclature of the BUMN Regulation Agency which is subsequently called BP BUMN.

2. Affirmation of Series A Dwi Warna share ownership of 1 percent by the state at the BP BUMN Agency.

3. Arrangement of stock composition in the Investment Holding Holding Company and the Main Operations Company at the Danantara Investment Management Agency.

4. Arrangements related to the prohibition of concurrent positions for ministers and deputy ministers on the board of directors, commissioners, and supervisory boards of SOEs as a follow-up to the decision of the Constitutional Court.

5. The abolition of the provisions of members of the board of directors, board of commissioners, and supervisory board of SOEs is not a state administrator.

6. Arrangement of the position of the board of commissioners at the Investment Holding and Operational Holding filled by professionals.

7. Regulation of the SOE's financial audit authority by the Supreme Audit Agency in order to increase transparency and accountability in the financial management of SOEs.

8. Addition of BP BUMN's authority in optimizing the role of SOEs.

9. Affirmation of gender equality for BUMN employees who occupy the positions of directors, commissioners, and managerial positions in BUMN.

10. Tax treatment for transactions involving agencies, Operational Holding, Investment Holding, or third parties regulated in government regulations.

11. Arrange for the exception of BP BUMN control to BUMN which is designated as a fiscal tool.

12. Arrange the mechanism for the transfer of employment status from the Ministry of SOEs to BP BUMN, as well as other substance arrangements.
