DPR Proposes BP BUMN To Have Authority To Approve Or Reject BPI Danantara's Work Plan
JAKARTA - Commission VI of the DPR RI agreed to approve the Draft Law (RUU) for the Fourth Amendment to Law Number 19 of 2003 concerning State-Owned Enterprises (BUMN) to be brought into level II talks at the upcoming plenary meeting.
Even so, Member of Commission VI of the DPR, Rivqy Abdul Halim, gave a number of notes so that the government should pay attention to the direction of SOE management in line with the constitutional mandate. He emphasized that all BUMN policies and governance must be based on Article 33 of the 1945 Constitution.
"The formulation of policies, regulations, and management of SOEs must be based on Article 33 of the 1945 Constitution," said Rivqy, Friday, September 26.
Rivqy reminded that Article 33 of the 1945 Constitution emphasizes that production branches that are important for the state and those that control the lives of many people must be controlled by the state and used as much as possible for the prosperity of the people.
"The principle of kinship and orientation of people's welfare must not be lost in every decision related to SOEs," said Rivqy.
He said that his party also agreed to change the nomenclature of state-owned government institutions managing SOEs in the form of the BUMN Regulatory Agency. According to him, with this new nomenclature, SOE management can be more optimal and avoid the confusion of authority with the Danantara Investment Management Agency.
"We propose that the BUMN Regulation Agency has the authority to approve or not approve of the work plan submitted by BPI Danantara," said the spokesman for the PKB faction.
It is known that the nomenclature of ministries in State-Owned Enterprises (BUMN) will be replaced to the BUMN Update Agency (BP) through the revision of the BUMN Law. This change in ministries to agencies is the first point result of the DPR Commission VI meeting with the government regarding the BUMN Bill.
In addition to changing the nomenclature, there are 10 other main changes in the draft law (RUU). The main points of the changes include regulating the transfer mechanism from the Ministry of SOEs to BP BUMN, as well as increasing the authority to play the role of BP BUMN in optimizing the role of SOEs. Then, regulate the issue of Dwiwarna series A dividends which are managed directly by BP BUMN with the approval of the President of the Republic of Indonesia
According to Rivqy, the BUMN Regulatory Agency must also have the authority to approve or reject the BUMN restructuring proposal by BPI Danantara. He considered that the BUMN Regulation Agency could approve or reject the proposed merger, merger, takeover or separation of SOEs by BPI Danantara.
"Of course the attitude of approving or rejecting is based on clear indicators and aims to optimize the performance of state companies for the welfare of the people," he said.
Rivqy also emphasized the importance of prudence in the management of state companies. Therefore, he emphasized, that in the management of BUMN profits and losses are the responsibility of BUMN itself.

Rivqy added that the notes that became the view of the PKB faction of the DPR RI were not only a guide for the implementation of the revision of the BUMN Law, but also as an evaluation of the management of SOEs so far which were considered to still face serious problems.
"So far, SOEs have often been criticized for being unprofessional, even being considered a dairy cow and a power-sharing tool," he said.
"PKB wants the management of SOEs to be truly directed towards the interests of the people, not the interests of a handful of parties," concluded Rivqy Abdul Halim.
