The House Of Representatives Approves The Revision Of 84 Articles Of The BUMN Law, The Minister Can No Longer Hold Positions
JAKARTA - The Working Committee (Panja) of the House of Representatives Commission VI Bill approved the Draft Law (RUU) on the Fourth Amendment to Law Number 19 of 2003 concerning State-Owned Enterprises (BUMN) by changing 84 articles which include a ban on concurrent positions, strengthening transparency, and encouraging gender equality.
Chairman of the Working Committee for the BUMN Bill Andre Rosiade said the number of articles revised made this discussion the biggest change since the BUMN regulation was first implemented more than two decades ago.
"There are 84 articles that have been changed in this revision, ranging from the rules of office, the financial mechanism, to strengthening the role of supervision," said Andre during a Commission VI meeting in Jakarta, Friday, September 26.
He explained that one of the important substances is the prohibition of concurrent positions for the Minister and Deputy Minister as BUMN organs, both in the position of directors, commissioners, and the supervisory board.
This provision is a follow-up to the decision of the Constitutional Court Number 128/PUU-XXIII/2025 which confirms the need for separation of executive functions from SOE management.
The revision also removed the rules that members of the board of directors and board of commissioners were not state administrators.
Thus, officials within SOEs are now seen as having the status of state administrators who are obliged to comply with the principles of integrity and accountability of the public.
In addition, the DPR and the government agreed to include provisions regarding gender equality.
According to Andre, the new article regulates that women have the same opportunity to occupy the positions of directors, commissioners, and managerial positions within SOEs.
"This regulation provides equal space for women in the leadership of SOEs," he said.

This arrangement is intended to reinforce the government's authority in determining the direction of BUMN strategic policies.
The bill also emphasized the importance of transparency through the involvement of the Supreme Audit Agency (BPK).
With this new provision, BPK is given full authority to examine BUMN financial reports in order to increase accountability in the management of state assets.
Fiscal aspects are also strengthened by including tax regulations on transactions involving operational holding, investment holding, and third parties. The government is given the authority to regulate its technicalities through government regulations.
Andre added that this change also touched on the provisions regarding the mechanism for transitioning authority from the Ministry of SOEs to the BUMN Regulation Agency (BP BUMN).

The mechanism will be further regulated so that the institutional transition runs smoothly without disrupting the operations of state companies.
If it has been approved at level I, the Bill on the Fourth Amendment to the BUMN Law will then be brought to level II discussions or plenary meetings of the DPR RI to make decisions and be used as laws.
