President Jokowi And Mahfud MD Asked To Behave Related To TWK Polemic And Deactivation Of KPK Employees
JAKARTA - The deactivation of 75 employees of the Corruption Eradication Commission (KPK) due to passing the National Insight Test (TWK) assessment caused polemic in the public.
Many urged that President Joko Widodo (Jokowi) and Coordinating Minister for Legal And Security Politics (Menko Polhukam) Mahfud MD intervene to resolve this polemic.
Criminal law expert Abdul Fickar Hadjar asked Mahfud MD to reprimand KPK Chairman Firli Bahuri. This reprimand must be filed, because he considers the former Deputy Of Kpk Crackdown misinterpreted Law No. 19 of 2019 which regulates the status of employees of the antirasuah commission into the State Civil Apparatus (ASN).
"The Minister of Police must reprimand the Chairman of the KPK for misre interpreting the Law," legal expert Abdul Fickar Hadjar told reporters on Wednesday, May 12.
He also mentioned, 75 KPK employees who did not pass the National Insight Test assessment (TWK) should still be appointed as state civil apparatus (ASN). Because, TWK which is one of the conditions for employee status transfer should not be the deciding factor.
Moreover, if you look at the new KPK Law, the employees of the antirasuah commission should automatically become ASN. "The new KPK Law determines kpk employees asn then by itself, since the Law was passed, KPK employees have become ASN," he said.
Fickar also said that employees who do not pass TWK should not be disabled but given training to improve national insight.
Furthermore, he also said, The Ministry of Finance should be responsible for managing this transition mechanism. Because, the kpk leadership period itself only served for five years and will change.
"Institutionally (transfer of status, red) is the responsibility of the Minister of Finance (Tjahjo Kumolo)," he said.
In addition to Mahfud, President Jokowi was also asked to behave. Indonesia Corruption Watch (ICW) urged the former Governor of DKI Jakarta to reject the deactivation of dozens of KPK employees.
"ICW also urged that President Joko Widodo act immediately by rejecting the dismissal of dozens of KPK employees," ICW researcher Egi Primayogha said in a statement.
After all, what happened in the antirasuah commission body is due to Jokowi's policy. This includes choosing the controversial KPK leadership and accommodating the transfer of kpk staffing status through Law No. 19 of 2019.
"So, all issues arising from the political policy error of corruption eradication law must be placed as the responsibility of the President," he said.
The National Insight Test (TWK) was attended by 1,351 KPK employees. Of these, 1,274 were declared eligible.
Meanwhile, 75 employees, including Novel Baswedan, Chairman of kpk employee forum who is also an investigator Yudi Purnomo, Director of Socialization and Anti-Corruption Campaign KPK Giri Suprapdiono was declared ineligible (TMS) and two employees were not present in the interview test.
Furthermore, 75 employees who were declared ineligible were subsequently disabled. This deactivation is based on the Decree of the Kpk Leadership No. 652 of 2021.
The letter signed by KPK Chairman Firli Bahuri was set on May 7 and a valid copy was signed plh Head of HUMAN RESOURCES Bureau Yonathan Demme Tangdilintin.
Later, kpk senior investigator Novel Baswedan said that he is currently focusing on investigating a number of cases when he was disabled. Including, investigating the case of the legal mafia.
"I'm handling a legal mafia case," Novel told reporters Wednesday, May 12.
However, he did not elaborate further on the legal mafia case in question, as well as the status of the case whether it is still an investigation or investigation.
He said a similar fate wasn't just his. Novel mentions there are colleagues who are also investigating a major case in kpk but disabled for failing to pass the TWK assessment.
"There are (medium, red) cases handle (corruption, red) bansos, e-KTP cases also have not been kelar because related to state losses have not been withdrawn. Of course, there are other cases that are still being pursued," he concluded.
