Nvidia Criticizes The GAIN AI Bill, Calls Competition Barriers And Similar To AI Diffusion Rules

JAKARTA - Nvidia stated on Friday September 5 that the AI GAIN Bill would limit global competition for advanced chips, with similar effects on US leadership and economy such as the AI-Diffusion Rules, which limits computing power that other countries may have.

GAIN AI Act, abbreviation to the Guaranteeing Access and Innovation for National Artificial Intelligence Act, was introduced as part of the National Defense Authority Act. The bill requires that chipmaker AI prioritizes domestic orders for advanced processors before supplying them to foreign customers.

"We have never ignored American customers to serve the rest of the world. In an effort to solve problems that do not exist, the proposed bill will actually limit competition around the world in any industry that uses major computing chips," a Nvidia spokesperson said.

If passed into law, the bill will impose new trade restrictions requiring exporters to obtain licenses and approvals for silicon chip shipments that exceed certain performance limits.

The rule reflects some of the conditions under former US President Joe Biden's AI-Diffusion Rules, which allocate certain levels of computing power to allies and other countries.

The AI Diffusion Rules and the GAIN AI Bill are Washington's efforts to prioritize domestic needs, ensuring US companies gain access to advanced chips while limiting China's ability to gain high-end technology. This step was taken by the issue of concern that China would use AI capabilities to spur its military power.

Last month, President Donald Trump struck an unprecedented deal with Nvidia to give the government part of its sale in exchange for the continued export of AI chips banned from China.
