Novel Baswedan Et Al Fight, The Value Of Deactivation In KPK After Anomalous National Insight Test

JAKARTA - Senior investigator of the Corruption Eradication Commission (KPK) Novel Baswedan will fight following his deactivation along with 74 other KPK employees who did not pass the National Insight Test Assessment (TWK).

This resistance was done because they felt that the deactivation carried out through the Decree of the KPK Leadership No. 652 of 2021 was not a reasonable process.

Until now, he and dozens of antirasuah commission employees continue to hold discussions to fight.

"There will be a legal team from the civilian coalition who want to see that", Novel told reporters on Tuesday, May 11.

In the decree signed by KPK Chairman Firli Bahuri which was determined on May 7 and a valid copy signed by Head of Human Resource Bureau Yonathan Demme Tangdilintin, there are four points.

In addition to establishing the names of employees who did not pass the National Insight Test, this letter also governs the surrender of duties and responsibilities to their superiors pending further decisions.

"Because it's a bit funny too, Work Letter of assessment results but in it mentions handing over duties and responsibilities, not dismissal, you know", said the investigator.

He assessed, TWK which led to the issuance of the decree is an anomalous process. Because, this is not a selection to get rid of incompetent people.

"But this is a systematic effort that wants to get rid of people working well for the country", said Novel.

"So our stance is clear, we will fight back", he added.

Similarly, the KPK Chairman of Staff Yudi Purnomo Harahap will consolidate. This was done after the employee who did not pass the TWK assessment received the decree of the assessment result.

"KPK employees will certainly consolidate for the next steps we will take", Yudi said.

He also confirmed that ineligible employees are required to hand over their duties and responsibilities to their superiors. This certainly makes dozens of employees unable to do their jobs.

Thus, determining the next step becomes important. Because, in the decision of the Constitutional Court that was only tapped some time ago, the transfer of staffing status should not harm employees.

"The decision of the Court is clear that the transfer of status does not harm employees and the mandate of the revision of the KPK Law is only transfer of status from KPK employees to ASN (State Civil Apparatus). And the KPK Chairman must comply with that", he said.

KPK answers the issue of deactivation

After reportedly deactivating 75 of its employees, the anti-corruption commission spoke out. The KPK Spokesman for Enforcement Ali Fikri confirmed that it had submitted a copy of the Decree on the Results of the TWK Assessment to the superiors of each employee who did not qualify.

However, he denied KPK did deactivation of dozens of employees.

"We can explain that the employee is not disabled because all rights and responsibilities of staffing are still in force", Ali told reporters on Tuesday, May 11.

The purpose of the submission of duties and responsibilities as written in the Decree, claimed solely for the effectiveness of the implementation of corruption eradication tasks can run.

"The handover of this task is done solely to ensure the effectiveness of the implementation of tasks in the KPK so as not to be constrained and avoid any legal problems related to the handling of ongoing cases", he said.

He said that the implementation of the employee's next task will be based on the direction of the direct supervisor who has been appointed. In addition, to clarify the fate of these 75 employees, kpk coordinated intensively with the State Personnel Agency and the Ministry of Finance.

"KPK is currently coordinating intensively with the State Personnel Agency and the Ministry of Finance related to the follow-up of 75 employees", Ali said.

Previously, the Assessment of National Insight Test (TWK) was conducted on 1,351 KPK employees. The test in cooperation with the State Personnel Agency (BKN) is a condition of transfer of employee status from independent to state civil apparatus (ASN) as mandated by KPK Law No. 19 of 2019.

Of these tests, 1,274 employees were declared eligible. While 75 employees were declared ineligible and two were not present in the interview test.

In addition to Novel, there are a number of other employees who did not qualify such as KPK Chairman of Staff Yudi Purnomo Harahap and Director of Socialization and Anti-Corruption Campaign of KPK, Giri Suprapdiono.
