JAKARTA - Chairman of the State Personnel Agency (BKN) Bima Haria said employees of the Corruption Eradication Commission (KPK) will officially become the State Civil Apparatus (ASN) on June 1, coinciding with the birth of Pancasila.
"That's right, the plan is so (set on June 1, red)," bima said when contacted by VOI, Tuesday, May 11.
As for the results of the National Insight Test (TWK) followed by 1,351 KPK employees, 1,274 people were declared eligible. Meanwhile, 75 ineligible people and two employees were not present at the interview.
One of those who reportedly did not escape was kpk senior investigator Novel Baswedan. In addition to Novel, a number of task force heads (kasatgas) who handle major corruption cases are also reportedly not passing the assessment so as to cause polemics.
So what is the fate of Baswedan Novel, et al?
Haria Bima said that the fate of KPK employees who did not qualify twk was in the hands of KPK Chairman Firli Bahuri and four representatives.
"The current status of 75 (employees, red) TMS (Ineligible) is kpk employees. So it becomes the absolute authority of the KPK Leadership in determine their status after the test," he said.
Previously, Vice Chairman of kpk Nurul Ghufron said that his party will comply with the decision of the Constitutional Court (MK) which calls the process of transfer of status to state civil apparatus (ASN) should not harm the rights of employees.
"We will comply with the decision of the Court and will coordinate further with the Ministry of Administrative And Bureaucratic Reform (MINISTRY of Administrative And Bureaucratic Reform) and BKN (State Personnel Agency) regarding the follow-up results of TWK (National Insight Test) resulting in employees who MS (qualified) and TMS (ineligible)," said Ghufron.
He asserted that the process of transfer of status is carried out based on legislation starting from Law (Uu) No. 19 of 2019 on the Second Amendment to Law No. 30 of 2002 concerning the Commission for the Eradication of Corruption.
Furthermore, PP No. 41 of 2020 concerning the Transfer of KPK Employees to ASN Employees and KPK Regulation No. 1 of 2021 on Procedures for Transferring KPK Employees to ASN Employees.
In addition, on Tuesday, May 4, the Court has also decided to test the material of Law No. 19 of 2019 on the Second Amendment to Law No. 30 of 2002 concerning the Commission for the Eradication of Corruption.
"That on May 4, 2021, the Court has decided jr (judicial review) Law 19/19 which one of the main states that the transition of KPK employees to ASN is legally based on Law No. 19 of 2019 and whatever the process should not harm employees," said Ghufron.
Therefore, Ghufron insists that until now not a single KPK employee has been dismissed from the status transfer process.
"So I need to affirm that no KPK employees are dismissed, and we will fight for the process of transitioning KPK employees to ASN in accordance with the affirmation of the Court," he said.
