Referring to the Regulation of the Minister of State-Owned Enterprises (PermenBUMN) Number Per-02/Mbu/2009 concerning Guidelines for Determination of Directors Income, Board of Commissioners, and Supervisory Board of State-Owned Enterprises, State-Owned Enterprises tantiem is defined as income which is an award for members of the board of directors, board of commissioners, and the supervisory board of SOEs every year if the company's performance is good.

Tantiem was also given to the Board of Directors and the Board of Commissioners of the Persero if the company's performance increased even though it was still a loss.

Furthermore, the provisions regarding tantiem are also contained in the Minister of State-Owned Enterprises Regulation Number Per-12/MBU/11/2020 concerning the Fifth Amendment to the Minister of State-Owned Enterprises Regulation Number Per-04/Mbu/2014 concerning Guidelines for Determining the Income of the Board of Directors, Board of Commissioners, and Supervisory Board of SOEs.

In the regulation, tantiem (also called performance/IK incentives) is given proportionally based on the key performance indicator (KPI) in the related year.
