Commission III Of The House Of Representatives Holds Fit And Proper Test For Candidates For Single Judges Of The Constitutional Court

JAKARTA - Commission III of the DPR RI held a fit and proper test for the sole candidate for judges of the Constitutional Court (MK), Inosentius Samsul to replace Arief Hidayat who will retire in February 2026.

"We need to convey in accordance with the results of the consultation meeting, the Bamus meeting on August 19, 2025, which one of the agendas discussed an entry letter from the leadership of the Constitutional Court of the Republic of Indonesia number 3093.1/KP/07.00/08/2025 dated August 5, 2025, regarding the notification of the end of the term of office of constitutional judge Professor Arief Hidayat, a deliberation body meeting gave an assignment to Commission III of the DPR RI to discuss the replacement of constitutional judges," said Chairman of Commission III of the DPR, Habiburokhman at the Parliament Complex, Senayan, Jakarta, Wednesday, August 20.

"The mechanism for submitting a constitutional judge is carried out by means of objective and accountable active screening agreed in the internal meeting of Commission III of the DPR RI on August 19, 2025, this is in accordance with Article 20 paragraph 1 and paragraph 2 of the Constitutional Court," he continued.

The candidate for Chief Justice of the Constitutional Court, Inosentius Samsul, then explained his vision and mission in front of the leadership and members of Commission III of the DPR RI. Inosentius was previously the main expert official in the DPR RI's Expert Board and was the only candidate chosen by the DPR RI.

"Regarding the vision, so when asked about my vision, yes, with this experience in struggling in the DPR which is more than 35 years, then a question, what do you want to do to the Constitutional Court? So I hope that the leadership and members of the council, the point is to keep the Constitutional Court as a judicial institution into an independent and accountable justice power," said Inosentius during a fit and proper test.

He explained that the independence in question is free from influence or intervention from certain parties. Free from the assumption that certain circles' opinions are always correct and the DPR always produces quality laws.

"This is my reflection, as long as it happens that my job as head of the agency is to prepare a statement from the DPR so far, there is an impression that the opinion of certain groups is the most correct in this Republic. Then the DPR's products are considered underquality or bad even though there are many things that we have to fix that way of thinking. Now this is what I might fix," he explained.

"This means to place fair thinking. So independence is not influenced by the thoughts of certain groups or groups of thought. And also free from the assumption that what the DPR is doing is also for the benefit of this country. So it does not provide or pessimistic about the products produced by the DPR," said Inosentius.

Inocentius also hopes that the Constitutional Court can produce a quality decision and can be accounted for from the basic side of its constitutionality and rationality, as well as legal reasoning of benefit and justice for the community.

"I think this is the basic theory of justice or the importance of law, and the third is a transparent Constitutional Court," he added.

In the future, Inosentius also hopes that the Constitutional Court will truly become a trusted place to be able to resolve problems and seek presence for anyone including four groups, namely a country whose constitutional rights are disadvantaged, disputed state institutions, organizers and election participants, and political parties in the dissolution of political parties.

"Misi yang dalam rangka menjalankan visi tersebut. Pertama, menjaga integritas sebagai hakim MK melalui taat pada aturan. memberikan sanksi kepada pihak yang melanggar aturan. Dan menerima sanksi apabila ada pelanggaran, serta menjadi contoh bagi hakim serta pegawai di lingkungan MK," ungkapnya.
