The Owner Of Ruko In Pademangan Is Crowded With Lawsuits For The Administrative Court, What's Up?

JAKARTA - As many as 42 residents of the Marinatama shophouse in Pademangan, North Jakarta, filed a lawsuit for the cancellation of Certificate of Use Rights (SHP) Number 477 at the Jakarta State Administrative Court (PTUN), Cakung, East Jakarta.

The lawyer for the shop owner, Subali, said that the lawsuit to the Jakarta Administrative Court began when the residents had purchased a shophouse in 1997 with the Sale and Purchase Binding Agreement (PPJB) to PT WB.

However, in the midst of the time, suddenly in 2001 the North Jakarta National Land Agency (BPN) issued SHP Number 477.

"Of course this makes the residents who own the shophouses worried. In fact, after the residents signed the PPJB, WB promised to issue a Certificate of Right to Build (SHGB)," said Subali, quoted from ANTARA, Wednesday, August 6, 2025.

However, until now what was promised to the shop owner was only decoration. It is proven that from 1997 until now the HGB certificate has not been issued.

"In fact, currently the shophouse is managed by cooperatives in one institution," he added.

Not only that, residents are required to pay an extension rental with an unreasonable price of Rp. 300 million per year, but to get a 50 percent discount, so to pay Rp. 150 million.

He considered that the issuance of the SHP was contrary to Government Regulation Number 8 of 1953 concerning Control of State Land.

One resident named Wisnu said that he and other residents strongly objected to the extension of the lease which did not make sense through a circular from the cooperative of one of the institutions dated June 19, 2025.

"We and the residents are required to pay rent of one hundred and fifty million rupiah per year. The price of the rental extension is very strangling us and other residents," he said.

Another resident, Robert admitted that he was surprised by the Land and Building Tax (PBB) listed on behalf of Primkopal and himself, but he had to pay.

"I'm surprised why the UN exists in the name of Primkopal and me, but I pay the PBB every year," he said.

However, from a statement by North Jakarta BPN officers, Machmur who was assigned to the trial revealed that nothing was against it.

"There is nothing against it, if it is a conflict, the proof comes out of the SHP," he said.
