PT WKM Proposes Pretrial Highlights Allegations Of Criminalization And Deviations Of Legal Procedures
PT Wana Kencana Mineral (WKM) submitted a pretrial application at the South Jakarta District Court. The request is related to the determination of the suspect against a number of company personnel who are considered full of irregularities.
It is known that the pretrial lawsuit was filed by Hari Aryanto Dharma Putra,men Hafidz (Permohon I), and Marsell Bialembang (Pemohon II). The three were named as suspects in connection with the alleged installation of stakes in the concession area belonging to PT WKM itself located in Tail Village and Misaca, South Wasile District and North Weda, North Halmahera Regency.
The applicant's attorney, Desyana, said that the act of installing the marker was a preventive effort to protect the PT WKM Mining Business Permit (IUP) area from alleged grabbing by another party, namely PT Position, which is strongly suspected of carrying out illegal mining activities in the area.

Regarding irregularities in the case handling process, it occurred during the examination of witnesses that did not match the chronology. Where witnesses have been examined since March 2025 even though the new report was submitted to law enforcement officials in April.
"Differences in the articles and methods of investigation of the applicants who are considered inconsistent, the absence of the respondent in the trial raises questions about the openness and seriousness of handling this case," Desyana said in his statement, Saturday, August 2.
The overlap of legal reports at the National Police Headquarters and North Maluku Police levels has not been resolved properly.
Follow-up Session: Monday, August 4, 2025, the pretrial hearing will be held again on Monday, August 4, 2025, with an agenda of official response from the respondent and submission of documents and proof of letters from the applicant.
In addition, to date as many as 30 pieces of letter have been submitted by the legal team to support the pretrial application.
