17 Problems Found By The KPK In The Criminal Procedure Code, Deputy Minister Of Law And Human Rights Said 'It Has Been Discussed'
Deputy Minister of Law and Human Rights Edward Omar Sharif Hiariej said the 17 points of the problem conveyed by the Corruption Eradication Commission (KPK) regarding the Draft Law on the Criminal Procedure Code (RUU KUHAP) had been discussed with the anti-corruption agency.
The problem is related to the discrepancy between the Criminal Procedure Code and Law Number 19 of 2019 concerning the Second Amendment to the KPK Law.
"Yes, it has been discussed and talked again with the KPK," said Eddy, his nickname, when met after the Public Discussion on the Anti-Tindak Day of Trafficking in Persons (TPPO) in Jakarta, Antara, Thursday, July 31.
However, Eddy emphasized that further discussions are under the authority of Commission III of the DPR RI, which is currently still working on the bill.
Previously, KPK spokesman Budi Prasetyo said that the KPK found at least 17 problems in the draft of the Criminal Procedure Code Bill. One of the highlights is the loss of specialities or lex specialists of the KPK, which has the potential to weaken the institution's authority in handling corruption cases.
"KPK cases will only be resolved based on the Criminal Procedure Code, even though the KPK has special authority which has been regulated in its own law," said Budi at the KPK's Red and White Building, Jakarta, Wednesday (16/7/2025).
The KPK also highlighted the non-commodation of the existence of KPK investigators in the Criminal Procedure Code Bill. In the draft, investigators only come from the National Police and are under the supervision of police investigators.
In addition, the definition of investigation in the Criminal Procedure Code only includes efforts to find and find criminal events. In fact, according to the KPK Law, the investigation aims to find at least two pieces of evidence to raise the case to the investigation stage.
On the other hand, Deputy Speaker of the Indonesian House of Representatives, Sufmi Dasco Ahmad, stated that Commission III of the DPR had asked for permission to hold a meeting during the recess period to absorb public aspirations regarding the revision of the Criminal Procedure Code.
He emphasized that the DPR is committed to prioritizing public involvement in the discussion of the revision.

"This is still in the stage of public participation. If there is an issue that the Criminal Procedure Code Bill will soon be passed, it has proven not to be true," said Dasco at the parliament complex, Jakarta, Friday (25/7/2025).
Regarding the news that the KPK had written to the DPR to be involved in the hearing on the discussion of the Criminal Procedure Code, Dasco admitted that he had not checked the information.
