Indonesia-US Data Transfer Agreement Not Final, Deputy Minister Of Communication And Digi: That's Commercial Data
JAKARTA - Deputy Minister of Communication and Digital Affairs, Nezar Patria, emphasized that the agreement regarding cross-border data transfer between Indonesia and the United States is not final, but is still in the process of being discussed.
"In the coordination stage and what was conveyed yesterday is not final. So there are still technical matters discussed by the American government and also the Indonesian government, so it is still ongoing," said Nezar on Monday, July 28 in Jakarta.
Nezar also asked the public not to misunderstand this agreement. Because according to him, this cross-border data transfer process is not carried out arbitrarily, and is in accordance with applicable regulations, namely Law Number 27 of 2022 concerning Personal Data Protection.
"Please don't misunderstand, it doesn't mean that Indonesia can transfer all personal data freely to America, we still have protocols as regulated by the PDP Law," he said.
According to Nezar, the data intended in this agreement clause is commercial data, when people use or access search engines, social media, and e-commerce.
According to him, the cross-border data transfer process like this has also been carried out by the public. However, this agreement is expected to accelerate the regulation process of the PDP Law.

"Actually, it has been like that (there has been cross-border data transfer so far) and we are grateful that the PDP Law already exists. With this agreement, it will accelerate, I think the regulatory process regarding the law or what we call government apparatus for the PDP law," he explained.
It is not yet known whether the public will receive a notification for the approval of this data collection or not. Because said Nezar, the technical process related to cross-border data transfer is still in the discussion stage further.
"Well, technically it will be arranged there, so there are words asking for clarification, yes, from the process of transferring personal data, this will be done technically later," he said.
