Commission XIII Of The House Of Representatives Urges Sanctions For Perpetrators Of Sexual Violence In Unsoed In Accordance With The TPKS Law

JAKARTA - Chairman of Commission XIII DPR RI Willy Aditya, urged that every perpetrator of sexual violence be subject to criminal sanctions by using Law No. 12 of 2022 concerning Non-Criminal Crimes of Sexual Violence (TPKS Law).

This was conveyed by Willy following allegations of sexual violence by a professor against his student at Jenderal Sudirman University (Unsoed), recently.

According to Willy, the mechanism for handling sexual violence should be in accordance with the TPKS Law. Because Willy is surprised, it has been three years since the TPKS Law has been implemented but no one has been charged with this law.

"Cases that occur at Unsoed cannot use Permenristekdikti which only punishes administratively. Uncivilized behavior in an educational environment should be dealt with very firmly with the TPKS Law. Whether he is a professor or parking attendant, everything is the same before the law," said Willy, Monday, July 28.

Willy also brought up the progressive spirit of ratification of the TPKS Law which was created to alleviate the problem of 'chronical' sexual violence in Indonesia. According to the former Chairperson of the TPKS Bill Working Committee, this law is quite complete and clearly regulates penalties for perpetrators.

"Even not only about punishing the perpetrators, improving the sense of justice for victims and the mechanism for procedural law and rehabilitation is also available," explained Willy.

Therefore, Willy assessed that the old regulations in academics and other community environments that have not referred to the TPKS Law must be changed immediately. He emphasized that delaying the settlement of cases of sexual violence means punishing victims.

"This TPKS Law places the victim as the crown of disclosure of the case. So it cannot take long to find materials to be examined, while the perpetrator is still on the loose," he said.

"The campus should be a Avant garde to advance civilization without sexual violence," added Willy.

The chairman of the Commission in the DPR in charge of Human Rights (HAM) affairs encouraged the government to immediately issue implementing regulations from the TPKS Law. Because according to Willy, cases of sexual violence cannot only be resolved with administrative sanctions.

"Collaborative work and commitment are important. If we just wait, we will extend the ranks of victims. So it needs progressive action," said the Deputy Chairperson of the DPR Baleg for the 2019-2024 period.

"The public uses the TPKS Law as the basis for reports, law enforcement officials handle it by finding legal practices, as well as judges and all related parties," added Willy.

Willy also stated his commitment to support community groups, law enforcement officers, and all parties moving towards awareness of the use of the TPKS Law. Especially for the government so that implementing regulations from the TPKS Law are immediately issued considering that it has been 3 years since this law was passed, but there are still technical regulations that have not been made.

Willy also ensured that he would continue to oversee cases of sexual violence as happened at Unsoed, as part of his moral responsibility and social summons as a member of the DPR. Moreover, this is related to the fulfillment of the rights of victims, which are human rights (HAM) as individuals.

"The DPR will continue to monitor cases at Unsoed and others. We need to commit that similar cases must be completed with the mechanism provided by the TPKS Law," concluded Willy.

As reported, Professor of Jenderal Sudirman University (Unsoed) Purwokerto is suspected of sexually assaulting his students.

The rectorate has formed an Examining Team consisting of seven people to resolve the alleged sexual violence case. Meanwhile, the Police are investigating to gather initial information, although there has been no official report regarding this case.
