Guaranteed Great People And Toddlers, Suspension Of Jumhur Hidayat Detention Granted

JAKARTA - The Panel of Judges at the South Jakarta District Court (PN Jaksel) has granted the suspension of detention of activists from the Action Coalition to Save Indonesia (US) Jumhur Hidayat.

Thus, Jumhur was able to get out of the Police Criminal Investigation Agency (Rutan Bareskrim) Detention Center and return home to meet his family.

"Earlier (during the trial, ed) the Panel of Judges granted the request for suspension of detention that the attorney submitted it," said Oky when contacted in Jakarta, reported by Antara, Thursday, May 6.

He explained that the Panel of Judges in their consideration stated that Jumhur Hidayat, the defendant in the case of spreading false news and hate speech, was cooperative during the trial.

"The defendant has a child who is still under five and there are 17 guarantor who are ready to guarantee the suspension," he added.

Therefore, Jumhur at the next trial will come himself from his residence without being picked up by the detention car of the South Jakarta District Prosecutor's Office, Oky explained.

Jumhur's team of legal advisers, most of whom are public lawyers for the Jakarta Legal Aid Institute (LBH), submitted a letter requesting a suspension of detention to the Panel of Judges during a trial at the South Jakarta District Court, Monday, May 3.

In the letter, around 17 to 18 public figures, ranging from the former head of the Constitutional Court, politicians, and representatives of business groups, expressed their willingness to guarantee the suspension of Jumhur's detention.

The underwriters, among them are the Chief Justice of the Constitutional Court for the 2003-2008 Period Prof. Jimly Asshiddiqie; Chairman of the Constitutional Court for the 2013-2015 Period Hamdan Zoelva; former coordinating minister for the economy, Rizal Ramli; Constitutional Law Expert Dr. Refly Harun; management of KADIN (Indonesian Chamber of Commerce and Industry) Akhmad Syarbini; Head of the Democratic Party's DPP Election Winning Body Andi Arief; Founder of the Indonesian Legal Aid and Human Rights Association (PBHI), Paskah Irianto; former presidential spokesperson Adhie M Marsadi, former member of Commission III DPR RI Ahmad Yani; Deputy Chairman of the Gerindra Party, Ferry Joko Yuliantono; Democratic Party politician Rachland Nashidik.

Other public figures listed as guarantor for the suspension of Jumhur's detention, namely politicians Ariady Achmad, Abdul Rasyid, Asrianty Purwantini, Radhar Tri Darsono, Bambang Isti Nugroho; Harlans Muharraman Fachra; Rizal Darma Putra; Wahyono, and Andrianto.

Jumhur was detained by the Directorate of Cyber Crime at the National Police Criminal Investigation Unit on October 14, 2020 and from then on until May 6, 2021 or for more than 200 days he has been at the Police Criminal Investigation Detention Center, Jakarta.

Before granting the adjournment, the Panel of Judges said the chairman of the Jakarta High Court had extended Jumhur's detention period as requested by the Panel of Judges, Oky said.

However, when the extension letter came out, the Panel of Judges discussed and decided to grant the request for the suspension of Jumhur's detention.

The Panel of Judges then announced that the trial would resume on Monday next week (10/4) with an agenda of examining fact witnesses, Oky added.

Prosecutors have previously charged with intentionally and without right of spreading fake news that caused chaos.

Regarding the charges, Jumhur was charged with two alternative articles, namely Article 14 Paragraph (1) in conjunction with Article 15 of Law Number 1 Year 1946 of the Criminal Code or Article 45A Paragraph (2) jo. Article 28 Paragraph (2) Law No.19/2016 on Amendments to Law No.11 / 2008 concerning Electronic Information and Transactions.
