Komnas HAM Chairman Asks For An Extension Of The Criminal Procedure Code Bill

JAKARTA - Chairman of the National Human Rights Commission (Komnas HAM) Anis Hidayah requested that the discussion of the Draft Law (RUU) on the Criminal Procedure Code (KUHAP) be extended.

According to Anis, this is necessary to ensure the accommodation of records from Komnas HAM, academics, civil society, and other rights institutions, such as Komnas Perempuan, the Ombudsman, and the Witness and Victim Protection Agency (LPSK).

"I think, from us, of course Komnas HAM agrees that this discussion will be extended. So, it's not pulling back, yes, but how to extend the discussion," said Anis in a public discussion reported by ANTARA, Friday, July 18.

He hopes that the proposal to extend the discussion period of the Criminal Procedure Code can be accepted by Commission III of the DPR RI so that the principles can be discussed more comprehensively.

"We encourage and agree that this discussion may still be extended so that it still provides space for especially very principled things that could later disrupt or risk creating human rights violations in the law enforcement process, at least we can minimize it," he said.

Meanwhile, the Deputy Minister of Human Rights who was also present at the discussion said that input from institutions and civil society was important to pay attention to legislators.

He believes that the revision of the Criminal Procedure Code is carried out with the spirit to improve. However, he assessed that the discussion of the Criminal Procedure Code could not be repeated starting from scratch, considering that the new Criminal Code (KUHP) will take effect from January 2, 2026.

In my opinion, the most important thing then is how the inputs were given by the DPR for us to discuss once again. Yes, of course we can't start from scratch," he said.

He said that if it is not possible to make significant changes as recommended by institutions, academics, and civil society, there needs to be a breakthrough that allows substantive input to be accommodated.

Member of Commission III of the House of Representatives, Hasbiallah Ilyas, said that the discussion of the Criminal Procedure Code had actually been carried out for a long time.

"We discussed it a few months ago, a number of months," he said.

In addition, Hasbi said that the discussion of the Criminal Procedure Code had been carried out transparently. Commission III of the DPR, he said, also invited various organizations to hear the input.

"Commission III is very transparent. From the initial stage, from the first stage to today, we have opened it transparently," he said.
