The Constitutional Court Asks For The Fault Of The DPR Meeting To Discuss The TNI Law At The Hotel For Cross Check
JAKARTA - Constitutional Court (MK) Judge M. Guntur Hamzah asked the minutes of the DPR meeting regarding the discussion of the draft TNI Law at a hotel in the Senayan area, Jakarta, for the purpose of a re-examination (cross-check).
Guntur conveyed this in a follow-up hearing on formal testing (formil) of Law Number 3 of 2025 concerning Amendments to Law Number 34 of 2004 concerning the TNI in the Plenary Court Session Room, Jakarta, Monday, July 14.
"To the DPR, the Government, because this concerns the consignment meeting, is there any, yes, some kind of minutes related to the meeting or minutes that we can get the documents?," said Guntur as quoted by ANTARA.
Guntur asked the minutes document to the President Expert Lawmaker of the Indonesian House of Representatives, Inosentius Samsul, who was present at the trial as a parliamentary representative. The mistake were needed to re-examine the witness statement.
"So that we can after listening to the testimony from the witness, we can cross-check, yes, based on of course the minutes or there are minutes from the discussion consignment meeting at the Fairmont? Maybe that's what we want to ask for the documents," he said.
As for Monday's trial, case applicant Number 81/PUU-XXIII/2025 presented the Deputy Coordinator for External Affairs of the Commission for Missing Persons and Victims of Violence (KontraS) Andrie Yunus as a witness.
Andrie told the chronology of the civil society coalition entering the discussion meeting on the draft TNI Law which was allegedly carried out behind closed doors at a hotel on March 15, 2025.
Meanwhile, responding to Judge Guntur, Inosentius Samsul said that every meeting in the DPR always had minutes. Therefore, his party will prepare minutes of the DPR meeting regarding the draft TNI Law to be given to the Court.
"We will prepare the mistake. Then the information, then a study, perhaps, we will convey the minutes of the meeting at the Fairmont because it also exists, and coincidentally the DPR has not submitted additional information. And all the questions will be completed on the information to be delivered," said Inosentius.
Case number 81 was requested by the Indonesian Legal Aid Foundation (YLBHI), the Participatory Community Initiative Association for Fair Transition (Impartial), KontraS, Inayah WD activists Rahman and Fatiah Maulidiyanty, as well as Indonesian Law College students Jentera Eva Nurcahyani.
In addition to this case, the Court is also hearing four other TNI information testing cases at the examination stage, namely Case Number 45/PUU-XXIII/2025, 56/PUU-XXIII/2025, 69/PUU-XXIII/2025, and 75/PUU-XXIII/2025.
