Mediation Fails, Nikita Mirzani's Wanpresation Case Continues To The Main Case

JAKARTA - The mediation effort in the default case between Reza Gladys and Nikita Mirzani was officially declared a failure. This was expressed directly by Reza Gladys's attorney, Surya Batubara, after the mediation process which took place was tough and full of debate.

"Last week we mediated (the default case), but the results were not clear, so this time we tried to come and review the criminal case," Surya Batubara told reporters.

He explained that the mediation which is expected to be the middle road actually takes place without direction and does not produce a solution.

"It turned out that there was mediation, so I came to mediate and the mediation was quite tough and not directed. Because there was an unclear debate. The mediation was to find the best solution, so that there could be peace," continued Surya.

However, because they did not find a common ground between the two parties, the mediation process was finally declared failed by the mediator judge.

"It turned out that there was a debate so that the mediation discussion did not have a common ground and was declared a failure," he said.

Another legal colleague, Robert Par Uhum, explained that the mediation mechanism, which should have been fair and in turns, could not have taken place properly.

"In the mediation trial, it was led by a mediator judge, he was in the middle and would invite the plaintiff to speak first, then the defendant spoke," explained Robert.

However, he continued, the defendant was deemed uncooperative in providing a solution, even triggering the atmosphere to heat up.

"He was the referee in the middle so we took turns looking for a solution. When we asked what his proposal was for this mediation, what they wanted, they didn't want to say what they wanted. It was Nikita's turn to talk, they were immediately interrupted," he explained.

The mediation atmosphere heated up, causing Robert to protest to the mediator.

"Earlier, my client was accused of being like a debate at a cafe. I immediately told the mediator, this is not mediation. This is a commotion in the mediation room. And the judge immediately arrested him, right. Immediately cut, mediation was no longer there. It went straight into the subject case," he said.
