NasDem: The Constitutional Court's Decision On Elections Has The Potential To Create A Poranda Achievement System
JAKARTA - Deputy Chairperson of the NasDem Party as well as Deputy Speaker of the DPR Saan Mustopa stated that the decision of the Constitutional Court which separates the implementation of national elections and local elections has the potential to destroy the state administration system because it is against the constitution.
"It has consequences about our state administration which will be a bit torn apart," said Saan as quoted by ANTARA, Tuesday, July 1.
For this reason, Saan said the NasDem Party wanted the Constitutional Court to be consistent with its previous decisions regarding the design of the electoral system in Indonesia because the Constitutional Court's decision was final and binding (finals and bindings).
"They have decided in 2019 to regulate the simultaneous elections, where the president, vice president, DPR, DPD, provincial, district and city DPRD with five boxes. That is the decision of the Constitutional Court itself," he said.
"Even when it was sued again, the Constitutional Court also did not grant it, instead provided options. Including, it included simultaneous election options in 2019. We want consistency related to that matter," he said.
Saan reiterated the attitude of the NasDem Party DPP towards the Constitutional Court's decision which was submitted to the public on Monday (30/6) night, that the Constitutional Court's decision if implemented could actually result in a violation of the constitution.
He explained that Article 22-E of the 1945 Constitution (UUD) states that elections are held every five years. Then, it was explained that the election was held to elect the president-vice president, members of the DPR, DPD, and DPRD.

Thus, when after five years of the DPRD period not being held by the DPRD election, constitutional violations occurred.
"So, if for example the Constitutional Court wants to separate (national and local elections) yes, he must change the Basic Law earlier. Well, if he is not based on that, what NasDem said is something that is unconstitutional and NasDem is committed to maintaining the Basic Law," he said.
Previously, on Thursday (26/6), the Constitutional Court decided to separate the national and regional elections with a minimum interval of two years or a maximum of two years and six months.
The national election includes the election of members of the DPR, DPD, as well as the president and vice president, while regional elections consist of elections for members of the provincial DPRD, district/city DPRD, as well as regional heads and representatives.
