Mbak Ita Gratification Case, Semarang Gapensi Chair Sued 5 Years 2 Months
SEMARANG - Chairman of the Semarang City Construction Implementation Association (Gapensi) Martono was sentenced to 5 years and 2 months in prison in a case of alleged gratification to former Semarang Mayor Hevearita G. Rahayu and her husband, Alwin Basri.
The Public Prosecutor of the Corruption Eradication Commission (KPK) Rio Vernika Putra in a trial at the Semarang Corruption Court, Monday, also demanded that the defendant pay a fine of Rp. 300 million which if not paid will be replaced with imprisonment for 3 months.
"To declare the defendant guilty of violating Article 12B of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001," he said in a trial chaired by Chief Judge Gatot Sarwadi as reported by ANTARA, Monday, June 30.
In their consideration, the prosecutor said that the gratuity given to the former number one person in Semarang City was related to the direct appointment project in 16 sub-districts.
Semarang City Gapensi received direct appointment work in 16 sub-districts based on the defendant's closeness to Alwin Basri.
In working on the direct appointment project with a budget of Rp. 16 billion, he said, the defendant asked for a fee of 13 percent of each job
The fee, he continued, was collected through field coordinators in each sub-district before being handed over to the defendant.
The prosecutor assessed that gratification to Hevearita and Alwin Basri came from the project fee, which amounted to Rp1 billion each because it had helped Gapensi get a job in Semarang City.

For receiving the gratuity, former Mayor Hevearita G. Rahayu and her husband, Arwin Basri, who served as Chair of the Semarang City PKK, never reported it to the KPK.
The defendant himself enjoyed Rp245 million which also came from the direct appointment project fee
In his claim, the prosecutor also asked the court to impose an additional sentence in the form of compensation for state losses amounting to Rp245 million.
Based on these demands, the judge gave the defendant the opportunity to present his defense at the upcoming trial.
