Incomplete, Attorney General's Office Returns The Unlawful Killing File Of FPI Laskar
JAKARTA - The investigating prosecutor at the Junior Attorney General for General Crimes (Jampidum), the Attorney General's Office (AGO) returned the investigation files for the unlawful killing case. The files were returned after being declared incomplete on April 30.
"The files for the alleged murder crime on behalf of the FR suspect and the MYO suspect who are suspected of violating Article 338 of the Criminal Code in conjunction with Article 56 of the Criminal Code to investigators at the Indonesian Police Criminal Investigation Agency (Bareskrim)," said Head of the Legal Information Center (Kapuspenkum) Attorney General Leonard Eben Ezher. Simanjuntak in his statement, Tuesday, May 4.
The investigation files were returned this afternoon or on Tuesday, May 4. So, with the return, the police investigating team must make up for the shortcomings.
In fact, the research prosecutor has also sent a note of shortcomings that must be completed. The note is contained in the letter P-19 Number: B / 1664 / E.2 / Eoh.1 / 05/2021.
Once complete, the investigator will delegate it back to the investigating prosecutor. Until later it will be declared complete.
"It was returned complete with instructions from the investigating prosecutor, both lacking formal completeness and material completeness," he said.
As previously, the National Police submitted the investigation file of the case of alleged unlawful killing to the Prosecutor's Office with two members of Polda Metro Jaya with the initials F and Y. Meanwhile, for one other suspect, EPZ, the investigation was stopped because he had died.
"Dittipidum Bareskrim Polri has carried out the stages of investigation, namely the submission of case files for the km 50 case, the death of 4 FPI soldiers allegedly committed by brothers F and Y," said Head of Penum, National Police Public Relations Division Kombes Ahmad Ramadhan to reporters, Tuesday, April 27.
Meanwhile, the EPZ suspect case file was not transferred. Referring to Article 109 paragraph 2, the investigation and investigation process is terminated because the person has passed away.
"Suspect 3, brother F, brother Y, and the late EPZ. EPZ passed away so that based on Article 109 paragraph 2 of the Criminal Procedure Code, the investigation against him is terminated," said Ramadhan.
