Pramono Regarding The Raperda For Non-Smoking Areas: It Doesn't Mean You Can't Smoke, Facilities Are Prepared
JAKARTA - DKI Jakarta Governor Pramono Anung emphasized that the Draft Regional Regulation (Raperda) for Non-Smoking Areas (KTR) which is being prepared by the DKI Provincial Government and the DKI DPRD do not aim to completely prohibit people from smoking in Jakarta.
"The local cigarette regulation does not mean you can't smoke. No. People but can't smoke in public places where there are many people. There will be spaced facilities for people to smoke," said Pramono in Muara Angke, North Jakarta, Thursday, June 12.
According to Pramono, the smoking ban rule in certain areas and the preparation of special smoking facilities have also been implemented in a number of developed countries. This should also be implemented in Jakarta.
"Even in developed countries, now everything has arranged like that. Even in developed countries where the air is open, there are places that people should not smoke. There is no prohibition in open places for people not to smoke," said Pramono.
Regarding the discourse on imposing a fine of Rp. 250,000 for anyone who smokes inappropriately, Pramono emphasized that this had not been decided until the draft regional regulation was ratified.
"Because this regional regulation is still under discussion, the figure does not yet know how much will be imposed," he said.
For information, currently Jakarta does not have local regulations governing non-smoking areas. Currently, the rules regarding the prohibition of smoking in public spaces are still regulated in Governor Regulation Number 88 of 2010 concerning Amendments to Governor Regulation Number 75 of 2005 concerning Prohibited Smoking Areas.
Currently, the DPRD and the DKI Provincial Government are finalizing the draft Raperda KTR. Some of the provisions include Article 4 which states that the area without cigarettes includes health service facilities, places for the teaching and learning process, places for children to play, places of worship, public transportation, workplaces, public places, integrated public spaces, and certain places that hold crowd permits.
Then, Article 14 includes the types of public places referred to in Article 14, ranging from modern markets, traditional markets, hotels or inns, apartments/rusun, restaurants or restaurants, recreation areas or entertainment venues, bus stops, terminals/stations/labors/airports, meeting halls, and other public places.
The DPRD also had proposed more detailed provisions in the KTR Raperda. The Democratic-Perindo faction of the DKI Jakarta DPRD proposed a minimum distance limit for consumption, sales, and promotion of cigarettes from sensitive facilities in Jakarta such as hospitals and schools.
This was expressed in a plenary meeting with the agenda of the general view of the DKI Jakarta DPRD faction towards the Draft Regional Regulation (Raperda) of Non-Smoking Areas (KTR) which is being prepared with the DKI Provincial Government.
"Article 1 states that an area without cigarettes is a place or room or area that is declared prohibited from smoking, producing, selling, advertising, and/or promoting cigarettes," said Member of the Democratic Party faction of the DKI Jakarta DPRD Andika Wisnuadji Putra Soebroto.
At least, according to the Democrat-Perindo faction, there must be a clearer definition of the area without smoking in the KTR Raperda.
The definition referred to by the Democrat-Perindo faction is the provision of a minimum distance of 200 meters for non-smoking areas from sensitive facilities in Jakarta.
"We are of the view that this definition needs to be equipped by setting specific radii, for example: 200 meters from sensitive facilities such as schools, children's playgrounds and places of worship, hospitals," he said.
The Gerindra faction of the DKI Jakarta DPRD proposed the inauguration of the phrase "public place" which is included in a non-smoking area in Article 4 letter h and Article 14 of the Raperda for Non-Smoking Areas. Gerindra asked that nightclubs be included in the provisions of a no-smoking area.
"In Article 4 letter h, it is stated that public places as part of the Non-Smoking Area (KTR), as well as Article 14 which clarifies the types of public places, it is necessary to add locations/areas, namely at night entertainment venues such as karaoke, nightclubs, live music cafes, because one of the causes of fires at night entertainment venues is cigarette butts," explained Gerindra faction member Ali Lubis in a plenary meeting of the faction's general view, Monday, May 26.
