Bribery Former Mayor Of Semarang Mbak Ita And Husband Sued 2.5 Years In Prison
SEMARANG - Defendant President Director of PT Deka Sari Perkasa (DSR) Rachmat Utama Djangkar was sentenced to 2 years and 6 months in prison in the alleged bribery case against former Semarang Mayor Hevearita G. Rahayu and her husband, Alwin Basri.
The Public Prosecutor of the Corruption Eradication Commission (KPK) Rio Vernika Putra also demanded that the defendant pay a fine of Rp. 200 million which if not paid will be replaced with a prison sentence of 3 months.
"Declaring that the defendant is found guilty of violating Article 5 paragraph 1 letter a of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001," said Riopadasidang, followed by the defendant Rachmat Utama online, reported by ANTARA, Wednesday, May 28.
The prosecutor explained that the defendant was proven to have given a gift or promise in the form of money amounting to Rp1.75 billion, which is a commitment fee for the project to procure tables and fabricated chairs for elementary schools in nine sub-districts in Semarang City.
The company owned by the defendant obtained work on the procurement of tables and elementary school chairs with a budget ceiling of Rp. 20 billion through the 2023 APBD Amendment.
According to Rio, the provision of IDR 1.75 billion to Hevearita and Arwin Basri is a 10 percent commitment to the realization of work worth IDR 18 billion.
The prosecutor explained that the defendant Rachmat Utama was proven to have given gifts or promises to state officials, even though Alwin Basri had asked not to hand over the money in December 2023.
This was because at that time there was still an investigation by the KPK into the alleged corruption case within the Semarang City Government.
However, the prosecutor stated that the defendant had proven to have given the gift or promise. This is based on the suitability of the evidence regarding the disbursement of money from the company owned by the defendant.
The defendant Rachmat Djangkar ordered the finance department of PT Deka Sari Perkasa to disburse Rp1.75 billion in December 2023 after the work on the procurement of tables and elementary school seats was completed and paid.
"The defendant disguised the disbursement of Rp1.75 from the company as a debt from the board of directors," said Riopadasidang, led by the Chief Judge Gatot Sarwadi.
In addition, he continued, there was a proposal by Alwin Basri to the Head of the Semarang City Education Office to budget for the procurement of tables and elementary school seats in the 2023 APBD Amendments.
The proposal for an additional budget that was not in the urgent category was approved by Hevearita as mayor at that time before the Semarang City DPRD was finally set.
He said Hevearita, who was aware of the additional budget proposal, did not make concrete efforts to reject Alwin Basri's request and instead approved the additional budget ceiling.
The prosecutor said there was a similarity of will between Hevearita and Arwin Basri in the alleged crime
Regarding the prosecutor's demands, the panel of judges gave the defendant the opportunity to present his defense at the next trial.
