Komdigi Regulation Number 8 Of 2025 Will Limit Free Ongkir Promos

JAKARTA - The Ministry of Communication and Digital Affairs has just released Ministerial Regulation (Permen) Number 8 of 2025 concerning Commercial Post Service on Friday, May 16 in Jakarta.

However, this Permen does not set an upper or lower limit rate directly. The reason is that the courier service rate will still be determined by each organizer based on the tariff formula which includes operational costs, capex, overhead, and profit margins.

"This is based on the law. In the postal law, it says the tariff is not set by the government. But it is determined by the organizers based on the tariff formula," said Gunawan Hutagalung, Director of Posts and Broadcasting, Director General of Digital Ecosystems, Ministry of Communication and Digital.

However, Gunawan said that the Minister, here the Minister of Communication and Digital Affairs, could set a service tariff limit if an unhealthy situation was found for industry players.

"Situational. When there was a raise to bottom, another business actor had reported it. The price was not true, it had killed another. Then we went down," he explained further.

In addition, through this Permen, the government has begun to implement a policy of limiting the promotion of courier service rates, including the "free shipping" promo, in order to maintain a healthy competition climate in the logistics and e-commerce sectors.

As stated in Article 45 paragraph (3), shipping cost promos that are below the Main Production Price (HPP) are only allowed for a maximum of three days in one month.

After crossing this limit, business actors are required to submit notifications and evaluations to the government if they want to extend the promotion period, whose goal is to ensure that the price offered is still reasonable and does not harm other business actors.

"So later, after for example 3 days of implementation, they ask for an extension, we will evaluate it. We'll see if the price is still feasible or not extended," he said.
