Regarding The TNI Guarding The Prosecutor's Office, Commission I Of The DPR F-PKB: No Law Is Violated

JAKARTA Member of Commission I DPR PKB faction, Syamsu Rizal, responded to the TNI's decision to escort prosecutors throughout Indonesia. He warned soldiers not to ignore their main duties.

Syamsu Rizal assessed that the TNI's move to oversee the Prosecutor's Office did not violate the rules. Because the army only carries out security, not participate in handling cases.

"There are no rules that prohibit the TNI from helping with security. So far, the TNI has been assigned to carry out security measures. So, no laws or government regulations have been violated by the TNI regarding the security of the prosecutor's office," said Syamsu Rizal, Thursday, May 15.

"Unless there is a clear prohibition that the TNI should not carry out security in law enforcement agencies or government agencies. This is not a prohibition. So, nothing has been violated," he continued.

However, continued the legislator from the South Sulawesi I electoral district, the TNI must also consider this step comprehensively. Because according to him, there are a lot of personnel needed. Namely, 514 Kajari multiplied by 20 soldiers, and 37 Kajati multiplied by 40 soldiers.

"That's a fantastic number. These soldiers must get assurances that they still have opportunities for career and professional military training. Do not let the ability to 'fight' weaken because of external duties," said Syamsu Rizal.

Syamsu Rizal said, if viewed in Law Number 34 of 2004 concerning the TNI, which was revised to Law 3 of 2025, there was no article prohibiting the TNI from carrying out security at the prosecutor's office or government office. On the other hand, Article 7 states that one of the TNI's duties is to assist government duties in the region, and assist the police in security and public order tasks.

"So, it is quite clear that the TNI can assist the government and carry out security to maintain public order," he explained.

The member of the House of Representatives commission in partnership with the Ministry of Defense said that what the TNI was doing was only in the field of securing the prosecutor's office, including the Attorney General's Office, the High Prosecutor's Office (Kejati), and the District Attorney's Office (Kejari). According to Syamsu Rizal, the TNI is not included in the handling of cases handled by the prosecutor's office.

"The prosecutor's office is still handling the case. The TNI is only securing it so that the case handling process runs well and smoothly," explained the man who is familiarly called Deng Ical.

Unlike if the TNI intervenes in handling cases, Syamsu Rizal emphasized, this is clearly not allowed. He reminded that the TNI was only involved in a case related to military crimes under the Deputy Attorney General for Military Crimes.

However, Deng Ical asked the TNI to carry out professional security and escort of the prosecutor's office. He stressed that soldiers should not intervene in handling cases, because it will damage law enforcement in Indonesia.

"We at Commission I of the DPR will certainly continue to supervise the work carried out by the TNI. If there is a problem with the TNI, we can summon the TNI Commander or the chief of staff of the force to ask for an explanation," explained Deng Ical.

As reported, the TNI Commander General Agus Subiyanto issued telegram No TR/442/2025 on May 5 containing orders to secure and escort the prosecutor's office.

Deng Ical emphasized that the TNI needed to review the telegram to make the Prosecutor's Office a priority classification. Security does not need to be done in all Kejari, but only the Prosecutor's Office is vulnerable.

"There is no need for all the Prosecutors. It is enough for Pamdal and Police in certain areas. Maybe the Prosecutor's Office, which is located in 3T or those who are vulnerable, needs security from the TNI," he said.
