Prosecutors Delegate Rohingya Smuggling Case To Court

The public prosecutor of the South Aceh District Attorney (Kejari) handed over files for the smuggling of Rohingya ethnic immigrants to the Tapaktuan District Court.

Head of the Intelligence Section of the South Aceh District Attorney's Office, M Alfryandi Hakim, said the case consisted of three files with four defendant candidates.

"The public prosecutor has transferred three files of the smuggling of Rohingya ethnic immigrants with four suspects or potential defendants to the Tapaktuan District Court, South Aceh Regency," he said as quoted by ANTARA, Friday, May 2.

M Alfryandi Hakim said that the suspects in the case had the initials F, R, A, and I. For suspect R and each one separate case file. Meanwhile, A and I, the case is in the same file.

"The public prosecutor charged the defendants with multiple articles, violating immigration laws, shipping laws, and the law to eradicate money laundering," said M Alfryandi Hakim.

The suspect R was charged with Article 120 Paragraph (1) of Law Number 6 of 2011 concerning immigration in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code in conjunction with Article 323 of Law Number 17 of 2008 concerning shipping in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code in conjunction with Article 2 in conjunction with Article 3 of Law Number 8 of 2010 concerning the prevention and eradication of the crime of money laundering.

Meanwhile, suspect F was charged with Article 120 Paragraph (1) of Law Number 6 Year 2011 in conjunction with Article 56 Paragraph (1) 1 in conjunction with Article 323 of Law Number 17 Year 2008 in conjunction with Article 56 Paragraph (1) 1st of the Criminal Code in conjunction with Article 2 in conjunction with Article 3 of Law Number 8 Year 2010 in conjunction with Article 56 Paragraph (1) 1st of the Criminal Code.

Meanwhile, suspects A and I in one file were charged with violating Article 120 Paragraph (1) of Law Number 6 Year 2011 in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code in conjunction with Article 323 of Law Number 17 Year 2008 in conjunction with Article 2 in conjunction with Article 3 of Law Number 8 Year 2010 in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code.

"The Tapaktuan State Court has also scheduled its trial on May 6, 2025. The inaugural trial with the agenda of hearing the indictment of the public prosecutor," said M Alfryandi Hakim.

Previously, the suspects were arrested by the police regarding the presence of 152 Rohingya immigrants in the waters of Labuhanhaji, South Aceh Regency, in October 2024. After a week in the waters, hundreds of immigrants were evacuated to the mainland.

From the results of the police investigation, the presence of ethnic immigrants is suspected of a criminal act of human trafficking, where the immigrants pay a sum of money to the suspect.
