After The Constitutional Court Accepts Judicial Review Of The ITE Law, The Minister Of State Secretary Asks For Freedom Of Opinion To Remain Landed On Responsibility

JAKARTA - Minister of State Secretary (Mensesneg) Prasetyo Hadi asked that the freedom of opinion that has been running in this country must continue to be based on a sense of responsibility in order to respect other parties.

The Minister of State Secretary's statement responded to the decision of the Constitutional Court on a number of articles in Law Number 1 of 2024 concerning Electronic Information and Transactions (UU ITE) which was previously sued.

"The Constitutional Court's decision which is then considered to be good news for freedom of expression. So, in our opinion, the most important thing is that we all understand that freedom of expression has also occurred and is also protected by the Basic Law," Prasetyo said in a voice recording received in Jakarta, Tuesday as reported by Antara.

In Decision Number 105/PUU-XXII/2024, the Constitutional Court stated that the phrase "other people" in Article 27A and Article 45 paragraph (4) of the ITE Law contradicts the 1945 Constitution of the Republic of Indonesia and has no conditional binding law as long as it is not interpreted "except for government institutions, a group of people with specific or specific identities, institutions, corporations, professions or positions".

Through this decision, the Constitutional Court corrected the meaning of the phrase "other people" in Article 27A so that it does not cover government institutions, institutions, professions, or corporations.

Criticism of public bodies or corporations can no longer be criminalized on the basis of defamation. This is considered in line with the principle of freedom of expression.

However, on the other hand, Prasetyo assessed that freedom of opinion was already running and protected by the 1945 Constitution of the Republic of Indonesia.

"Freedom of opinion must also be based on responsibility and not with hatred," he said.

According to him, the so-called freedom of expression does not convey anything that does not respect other parties who do not use data based on hatred and other negative things.

The Minister of State Secretary then invited all parties, "Let's have freedom of opinion that must still be based on a sense of responsibility."
