Sanksi Kepala Daerah Ke Luar Negeri Tanpa Izin, Belajar Dari Kasus Lucky Hakim

YOGYAKARTA Regent of Indramayu Lucky Hakim received the spotlight because he went abroad without permission from the Governor of West Java, Dedi Mulyadi. In fact, Dedi Mulyadi uploaded a photo of Lucky Hakim going on vacation to Japan on the Governor of West Java's personal Instagram and TikTok account. In his upload, Dedi highlighted Lucky Hakim's decision to go to Japan without permission. This sparked public curiosity over the sanctions of the head of the delegation abroad without permission.

The reason Dedi insinuated that Lucky Hakim's departure on vacation abroad without permission was indeed reasonable. The reason is that local officials, including the head of the village or his deputy, are not allowed to travel abroad without obtaining permission from the Minister of Home Affairs (Mendagri).

The prohibition of the head of the village going abroad without permission is contained in Law Number 23 of 2014 concerning Regional Government. Article 76 states that the head of the village is not allowed to do several things, one of which is traveling abroad without permission from the Minister.

Exceptions can be given to the head of the village and his deputy from the provisions if done for urgent treatment reasons.

Article 77 also explains that the sanction given to regional heads who go abroad without permission is in the form of temporary dismissal for 3 (three) months.

"Regional heads and/or deputy regional heads who travel abroad without permission as referred to in Article 76 paragraph (1) letter I are subject to a temporary suspension of 3 (three) months by the President for governors and/or deputy governors as well as by the Minister for regents and/or deputy regents or mayors and/or deputy mayors," reads paragraph 2 Article 77 in the Regional Government Law.

After Lucky Hakim's news to Japan without a viral permit, the Regent of Indramayu apologized to the Ministry of Home Affairs. Deputy Minister of Home Affairs (Wamendagri) Bima Arya explained that Lucky had apologized for his departure without permission. In the future, the Ministry of Home Affairs will summon the person concerned to ask for an explanation.

It is not clear when the summons will be made. What is clear is that the summons will be made after Lucky is already in Indonesia.

"Immediately, after he arrived in Indonesia and started activities in Indramayu," Bima Arya explained to reporters, Monday (7/4/2025).
