Law On Paying Zakat With Crypto According To Islam

YOGYAKARTA The Malaysian government's decision to allow its citizens to pay zakat using cryptocurrencies has drawn the spotlight. This then drew many questions about how to pay zakat with crypto according to Islamic law.

It should be noted that zakat is the pilgrimage of wealth. This means that worship is related to the property of a person. Zakat is very important in the view of Islam. In fact, zakat payments are in third place after Syahadat and Salat in the Rukun Islam.

In an article entitled Review of Fiqih Muamalat on Zakat Cryptocurrency Assets and published in the Multidisciplinary Journal of Science, it was stated that some Islamic economists considered crypto to be still haram. This view is based on the reason that crypto is still containing Gharar (uncertainty) and Maysir (spectulative).

However, there are also those who think that halal crypto is used for several reasons. For example, it does not contain usury, is recognized as a legal, transparent and safe medium of exchange, and is used for halal purposes.

The use of cryptocurrencies to pay zakat is still reaping debate. In an article entitled The Use of Bitcoin as A Means of Payment for Zakat According to the Perspective of Islamic Law published in Adliya: The Journal of Law and Humanity explains crypto law in payment of zakat.

In the journal, it was explained that many appealed to avoid using bitcoin, one of the cryptocurrencies, because it was an element of Gharar. In addition, transactions carried out with the currency are close to corruption (dams) compared to benefit (benefits).

The reason can be concluded that the use of bitcoin as payment of zakat is haram. The use of cryptocurrencies in zakat is also strengthened by MUI Fatwa No. 13 of 2011 concerning Zakat Law on Haram Assets. The fatwa states that zakat must be paid off from halal assets, both property itself and how to get it.
