VISION Disbands Four Points Included In The Material Test Of The Copyright Law To The Constitutional Court

JAKARTA - The Indonesian Voice Vibration (VISION) through its official Instagram account stated that a request for judicial review to the Constitutional Court (MK) was received on Monday, March 10.

Meanwhile, the judicial review was carried out for five articles contained in Law Number 28 of 2014 concerning Copyright (UUHC).

"Continuing our manifesto spirit, with great consideration that is good for all parties, we encourage the state to attend and provide fair legal certainty," reads VISI's statement.

"In an effort to contribute to this achievement, several VISI members together with the advocate team have submitted a Material Test that has been received by the Constitutional Court on Monday, March 10, 2025," he continued.

Although he did not mention the five articles in question, VISI explained the four points that were broadly discussed in the requested judicial review.

The four points are:

1. Does for performing rights, the singer must have permission directly from the songwriter?

2. Who is meant by users who legally have the obligation to pay royalties for performing rights?

3. Can people / legal entities collect and determine royal rates for their own forming rights, outside the LMKN mechanism and the rates determined by the Ministerial Regulation?

4. Issues of default of payment of performance royalties, are they categorized as criminal or civil?

Continuing his explanation, VISI stated that this legal step was taken to make the issue of permits/licence and royalties of performing rights clear, in order to lead to a better future.

This step we hope can be a mediator to make the situation lighter. In fact, what we are aiming for is mutual welfare, without any party being ruled out. Hopefully with one vision we can move towards a better future.

Meanwhile, the judicial review of UUHC involved 29 Indonesian singers as applicants. They are Armand Maulana, Ariel NOAH, Bunga Citra Lestari, Vina Panduwinata, Titi DJ, Ruth Sahanaya, Yuni Shara, Ikang Fawzi, Dewi Gita, Hedi Yunus, Mario Ginanjar, Rossa, Fadly Padi Reborn, and David Bayu.

In addition, there are also Judika Sihotang, Andien Aisyah, Raisa, Nino RAN, VIDI, Afgan, Tantri KOTAK, Arda ex Naff, Gamaliél, Rendy Pandugo, Teddy Adhitya, Mentari Novel, Ghea Indrawari, Nadin Amizah, and Bernadya.
