KPK Submits Hasto Kristiyanto Files To Prosecutors, When Will The Trial Start?

The Corruption Eradication Commission (KPK) officially handed over the case files of PDIP Secretary General Hasto Kristiyanto to the public prosecutor in the case of alleged bribery and obstruction of investigation related to fugitive Harun Masiku. With this delegation, how long until the Hasto case is tried?

As is known, Hasto was charged by the KPK with two counts at once. First, he is suspected of jointly bribing former KPU commissioner Wahyu Setiawan. Second, Hasto allegedly obstructed the investigation by hiding information related to Harun Masiku's whereabouts, who is still at large.

On Thursday, March 6, Hasto's case file was transferred from KPK investigators to the public prosecutor.

"Last day, Thursday, March 6, 2025, the suspect and evidence from investigators were carried out to the public prosecutor for the HK suspect case," said KPK spokesman Tessa Mahardhika.

Based on Article 138 paragraphs (1) and (2) of the Criminal Procedure Code (KUHAP), the public prosecutor has seven days to examine the files submitted by investigators. If declared complete (P21), the case can be immediately transferred to the court for trial.

However, if the prosecutor finds a shortage in the case file, the file can be returned to the investigator to be completed. Investigators were given 14 days to repair and hand the file back to the prosecutor.

Even so, the KPK is different from other law enforcement officers. Because investigators and public prosecutors are in one institution, their coordination is usually faster than the police or public prosecutor's process.

On the other hand, Hasto previously filed a pretrial against the status of his suspect. The first lawsuit was not received by the judge, then he filed a second pretrial lawsuit which is currently still being processed at the South Jakarta District Court.

However, based on Article 82 paragraph (1) letter d of the Criminal Procedure Code, pretrial lawsuits will automatically fall if the main trial of cases in court has begun.

"In the event that a case has begun to be examined by the district court, while the examination regarding the request to the pretrial has not been completed, the request has dropped," the article reads.

Thus, if the prosecutor immediately submits the file to the court and the main court of the case begins, then the second pretrial proposed by Hasto will automatically fall.

Now, the public is waiting for the public prosecutor's steps in handling this case. Will the trial start soon, or is there still a file repair before the trial process?
