Understanding Sanguinis Ius In Indonesia And How To Acquire It

YOGYAKARTA - Ius Sanguinis is an understanding that adheres to a person's citizenship that is determined based on the descendants of his parents, not where he was born.

This principle has important implications for a person's citizenship status, especially for those born abroad or have parents with different citizenship.

This article will discuss in-depth the valid Ius Sanguinis in Indonesia, including the legal basis, requirements, and procedures for obtaining Indonesian citizenship through the lineage.

Reporting from the Medan UMSU page, the principle of ius sanguinis is a citizenship principle that based a person's status on the lineage of his parents, regardless of where he was born.

Indonesia and countries in Europe, Continental and China are examples of countries that apply this principle.

Apart from Indonesia, there are several countries that are known to adhere to the principles of ius sanguinis, including the Netherlands, the Philippines, Germany, South Korea, Portugal, the People's Republic of China, Spain, and Greece.

Although Britain has also implemented this principle, there are several exceptions and specific requirements related to birth in the UK region and the British foreign region.

The advantages of the implementation of ius siuinis include the potential reduction in the number of foreign-derived citizens, maintaining close relations between the state and its people, and strengthening the sense of nationalism.

Reporting from the website of the Ministry of General Affairs of North Sumatra, the process of obtaining Indonesian citizenship status, which is often called naturalization, is a legal procedure for Foreign Citizens (WNA) to become Indonesian Citizens (WNI).

Citizenship of the Republic of Indonesia is regulated by a number of laws and regulations which are the legal basis. Law Number 12 of 2006 concerning Citizenship of the Republic of Indonesia is the main reference in understanding and determining a person's citizenship status.

This law is then clarified and completed by Government Regulation Number 2 of 2007 concerning Procedures for Obtaining, Losing, Cancellation, and Recurring Citizenship of the Republic of Indonesia, which undergoes changes through Government Regulation Number 21 of 2022.

In addition, there are other aspects related to citizenship, such as types and tariffs for non-tax state revenues, regulated in Government Regulation Number 28 of 2019.

Then, there is also a regulation from the Minister of Law and Human Rights which regulates in more detail the procedures for becoming an Indonesian citizen, such as Regulation of the Minister of Law and Human Rights Number 36 of 2016 concerning Procedures for Conveying Statements to Become an Indonesian Citizen and Regulation of the Minister of Law and Human Rights Number 21 of 2020 concerning Procedures for Submission of Applications for Citizenship and Submission of Minutes of the Oath of Providing Citizenship of the Republic of Indonesia.

The Ministry of Law and Human Rights accepts applications for citizenship with several channels, including based on the foreigner's own petition, because of mixed marriages, for foreigners who are meritorious or for the benefit of the state, as well as for children who have not received citizenship.

To apply for citizenship, a foreigner must meet the requirements stated in Article 9 of the Citizenship Law.

These requirements include: you are 18 years old or married; you have lived in the territory of the Republic of Indonesia for at least 5 consecutive years or 10 consecutive years; physically and mentally healthy; able to speak Indonesian and recognize the basics of Pancasila and the 1945 Constitution.

Applicants are also required to never be sentenced to 1 year or more in prison; do not have dual citizenship; have a job and/or a fixed income; and pay the cost of citizenship to the state treasury.
