The Ministry Of Industry Hopes That The Police Will Investigate The Flow Of Fictitious SPK Case Funds
The Ministry of Industry (Kemenperin) hopes that the Corruption Eradication Corps (Kortas Tipikor) of the National Police will trace the flow of funds for a fictitious work order (SPK) made by a former commitment maker (PPK) with the initials LHS.
"We expect CORtas Corruption investigators to track the flow of funds in this fictitious SPK case, especially related to the bribery article and the money laundering article (money laundering crime), including funds that were successfully accommodated by the LHS and then used to pay vendors who had previously received fictitious SPK, as well as sources of funds from several vendors," said Ministry of Industry spokesman Febri Hendri Antoni Arif as reported by ANTARA, Friday, February 14.
Febri said, based on the documentary evidence reported, it was suspected that there was a holding fund from several vendors to LHS accounts and colleagues.
From these LHS accounts, most of them flow to vendors who have obtained previous fictitious SPKs or such as ponzi schemes.
Some of it is used by LHS and colleagues for personal gain, and there are several transactions that are suspected of flowing to an artist or celebrity with the initials M reaching more than Rp400 million.
Febri said that Kortas Tipikor investigators were also expected to track down the source of funds provided by vendors to LHS colleagues. In the case of a Fictitious SPK, it is suspected that the source of the vendor funds came from several investors. The investor is thought to have come from individuals, financial institutions and state officials.
Febri said the Minister of Industry (Menperin) Agus Gumiwang Kartasasmita also views that this incident is a way to "clean up" within the Ministry of Industry in implementing the budget.
"The Minister of Industry ensures that budget implementers, including PPK, work according to applicable operational standards and procedures (SOPs)," he said.
The evidence submitted by the Ministry of Industry to Kortas Corruption included DIPA of the Directorate of Chemical Industry Hilir and Pharmacy of FY 2023, Decree on the appointment and appointment of LHS as Management Officer of DIPA TA 2023, Decree on the imposition of severe disciplinary penalties LHS as a fictitious civil servant, SPK-SPK, payment bills, and recapitulation of outgoing and incoming money.
The SPK created by LHS is a fictitious SPK with several explanations.
First, a work order signed by the alleged perpetrator (LHS) with the provider (investor) is not registered in the Electronic Procurement System (SPSE) of the Ministry of Industry. The SPK was issued by PPK without going through the established SOP. For example, the suspicion is not to report the winning candidate to the Secretary of the Directorate General of Chemical, Pharmaceutical, and Textile Industries (IKFT).
Second, the total budget ceiling used by the alleged perpetrators in each SPK, namely the budget for activities 019.EC.6058.QDI.001.051.A.522191, is only worth IDR 590,000,000, so it is impossible to become the basis for financing the work package whose value is above.
Third, the activities carried out by third parties (the alleged perpetrators) based on a fictitious SPK do not involve any employees of the Ministry of Industry. All work is only planned, attended or followed by parties who are not related to the Ministry of Industry or the Ministry of Industry's activity program.
Fourth, disbursement of the budget or transfer of accountability to the Provider's account (investor), not through the state treasury or the State Treasury Service Office (KPPN), but through a personal account.
In fact, if the work is a job financed by the state budget, then a direct transfer will be made to the account of the provider from the state treasury.
Febri explained that the vendors were suspected of giving some money to LHS with the aim of getting a procurement tender from the Ministry of Industry in accordance with what LHS offered.

However, the DIPA page shown is an activity of another echelon I unit at the Ministry of Industry, not the DIPA Directorate General of IKFT as conveyed by the LHS to vendors.
The Ministry of Industry expects vendors to be more careful in following the process of procuring government goods and services, for example, to be careful in verifying the validity of the SPK. Vendors are also asked not to be easily persuaded by the lure of obtaining large projects and returns.
