Candra Darusman's Explanation Regarding Songwriters Who Demand Royalties From Singers' Performances
JAKARTA - Musician Candra Darusman via Facebook, gave an explanation regarding the polemic of music royalties in Indonesia, which was later discussed because of the court's decision on the Ari Bias case with Agnez Mo.
In the explanation, Candra discussed how the songwriters' efforts to demand justice, not only were they intended to get royalties from music concerts, but also as an effort to enforce the law.
"This is certainly understood by all of us," Candra wrote in seeing the efforts of songwriters.
About wanting to be bigger and faster - it's okay, even though royalties from concerts are like deposits whose interest (royalti) is not immediately available, after all, when the creator's concert is not working, aka performing, but productive at home, making new songs so that added deposits, "he continued.
Regarding the Ari Bias and Agnez cases that have been decided by the Central Jakarta Commercial Court, Candra expressed his concern about the domino efe that may arise.
Furthermore, court decisions that must pay are transferred to singers (and or can spread to bands - which actually participate in using songs) cause disruption to the balance of the music ecosystem. No wonder there are concerns that domino effects will appear where similar lawsuits appear everywhere," he said.

Ethically, said Candra, it would not be good if the singer still received a job even though he knew the organizer had not yet taken care of the reward to the LMKN according to official regulations. However, this action cannot be blamed.
"Out of royalties obligations that should be fulfilled by the organizers, it is not prohibited if the singer wants to give direct appreciation to the hit maker (also others) whose songs are used, as a friendship gesture. But it is not the singer's obligation," he said.
The creator's lawsuit against the singer granted by the court makes sense if -> The singer's STATUS is as well as the organizer (person of the individual) - not the status of the perpetrator (singer'). For large events, usually the EO/promotor is a legal entity, the organizer. For small events, it is common to be held by the singer himself by forming a committee without legal entities.
