Cikarang District Court Bantau Accusations Of Minister Of ATR Nusron, Affirms Execution In Tambun According To Procedures

BEKASI - Cikarang District Court (PN), Bekasi Regency, West Java, denied allegations that the Minister of ATR/BPN, Nusron Wahid, said that the execution of land in Setia Mekar Village, South Tambun District was in accordance with procedures.

The spokesman for the Cikarang District Court, Isnandar Nasution, stated that the land execution process was carried out in accordance with applicable legal procedures, as followed up with the request for assistance submitted by the Bekasi City District Court referring to decision number 128/PDT.G/1996/PN.BKS dated March 25, 1997.

"We only carried out the delegation confiscated the execution. So previously there was a letter requesting assistance for the implementation of the activity referred to from the Bekasi District Court," he said as quoted by ANTARA, Monday, February 10.

He explained that all stages of confiscation of execution had gone through a statutory procedure, including during the constatering process or matching the object of execution.

The process was carried out on September 14, 2022 by inviting representatives of the Bekasi Regency ATR/BPN Office even though they were not present. He emphasized that the consolidating document had been received and signed by the relevant parties.

"Constatering to be submitted to the local ATR/BPN, has been received and signed. There is a receipt," he said.

He also ensured that the executions carried out were in accordance with the court's ruling which stated that other certificates that were not in accordance with the court's decision were no longer considered to have legal force.

"Regarding the verdict, it was stated there that the other certificates had no more legal force. This was in response to reports regarding buildings belonging to residents who were victims of the wrong eviction," he said.

The confiscation of the execution through the eviction of residents' buildings in Setia Mekar Village, South Tambun District, Bekasi Regency, by the Cikarang District Court has drawn controversy because it is suspected that there is a discrepancy between the point of execution and the dispute plan that has been determined.

Then Wahid explained that there are five buildings belonging to residents that have now been razed to the ground even though they are outside the object of the land disputed by the plaintiff.

The five buildings belonged to Asmawati, Mursiti, Siti Muhijah, Yeldi and the People's Housing Bank corporations. "If you look at the data, this is outside the disputed land, after we checked," he said, in Cikarang, on Friday (7/2/2025).

He said that based on data from the Ministry of ATR/BPN, the five houses were outside the land owned by a person named Kayat with the Certificate of Ownership number 706. "According to our data, it is outside SHM 706," he said.

According to him, the eviction error was because the Cikarang District Court did not involve the Bekasi Regency BPN in the execution of the verdict, even though there were a number of stages that had to be carried out, such as applying for the cancellation of the citizen certificate to the Bekasi Regency BPN Office before carrying out the execution.

"Until the eviction has not been notified, involved and there has been no request for eviction. So this is an execution process whose procedures are not correct. I think the occupants are still valid," he said.
