JAKARTA - President Director of PT Tigapilar Agro Utama Ardian Iskandar Maddanatja has been sentenced to 4 years in prison plus a fine of Rp. 100 million, subsidiary to 4 months in prison for bribing former Minister of Social Affairs Juliari Peter Batubara for Rp.1.95 billion related to the appointment of a company providing social assistance for the basic foodstuffs of COVID-19.
"Demand that the panel of judges at the corruption court (Tipikor) declare the defendant Ardian Iskandar Maddanatja legally and convincingly proven guilty of continuing a criminal act of corruption. Sentenced the defendant to 4 years in prison plus a fine of Rp. 100 million subsidiary 4 months in prison," said the prosecutor. The charge is based on the first indictment of article 5 paragraph 1 letter b of Law No. 31 of 1999 as amended by Law No. 20 of 2001 concerning Eradication of Corruption in conjunction with Article 64 paragraph 1 of the Criminal Code.
"The thing that is burdensome is that the defendant's actions did not support the government's program in realizing a government that is clean from corruption, collusion and nepotism, the act of corruption that the defendant committed during a national disaster was COVID-19. What relieves him is that the defendant is forthright and regrets his actions," he added. prosecutor Azis.
In this case, Ardian was judged to be proven proven to have bribed Juliari P Batubara with a total value of Rp1.95 billion related to the appointment of PT Tigapilar Agro Utama as the provider of social assistance for COVID-19 staples 9, 10, community stage and stage 12 as many as 115,000 packages.
PT Tigapilar Agro Utama is a company engaged in commodity trading, transportation and fertilizers.
In August 2020, Ardian and his wife, Indah Budhi Safitri, met Helmi Rivai and Nuzulia Hamzah Nasution. Nuzulia is known to be the nephew of the Ministry of Social Affairs Director General of Social Protection and Security Pepen Nazaruddin.
Nuzulia said there was a "fee" that Ardian had to give if PT Tigapilar wanted to be appointed as the provider of social assistance, at the request, Ardian agreed.
On September 14, 2020, PT Tigapilar was declared the 9th stage of the basic food provider and received 20,000 basic food packages. Nuzulia then asked for a "fee" of Rp.30,000 per package with Nuzulia's division of duties coordinating with the Ministry of Social Affairs including bill payments, while the implementation of social assistance was Ardian's job.
The fee money was given through two of Juliari's subordinates, namely Matheus Joko Santoso as the Commitment Making Officer (PPK) for the procurement of COVID-19 basic food assistance at the Directorate of Social Protection for Social Disaster Victims of the Ministry of Social Affairs for the period of April-October 2020 and Adi Wahyono as the Head of General Bureau of the Ministry of Social Affairs and PPK for the procurement of basic food assistance. Ardian gave a "fee" in stages, the first of which was Rp. 800 million to Matheus Joko Santoso on October 15, 2020 at the Ministry of Social Affairs office Cawang Kencana. The "fee" is for the provision of stage 9 social assistance by PT Tigapilar Agro Utama.
Second, at the end of October 2020 at the Coffee Shop on the 1st floor of the Grand Orchard Kemayoran hotel, Central Jakarta, Ardian gave IDR 350 million to Matheus Joko Santoso. The "fee" is for the procurement of stage 10.
Third, in November 2020 in Matheus Joko Santoso's room, Ardian, through Nuzulia Hamzah Nasution, with the help of Handy Rezangka, gave Matheus a "fee" of Rp. 800 million. The "fee" is for the provision of community social assistance packages as many as 20 thousand packages and for stage 12 as many as 25 thousand packages.
Regarding these demands, Ardian will submit a plea note on Monday, April 26, 2021.
