Demotion To Dismissal Threatens ASN Who Is Reckless To Go Home
JAKARTA - The flow of homecoming ahead of Ramadan and Eid Al-Fitr is now an activity of concern. This is because this has the potential for transmission of COVID-19 in large numbers in Indonesia. The current government is still unable to prohibit residents from going home. Only an appeal not to go home was issued.
Therefore, to reduce the quantity of travelers, Minister of Administrative Reform and Bureaucratic Reform (Menpan RB) Thahjo Kumolo prohibits the State Civil Apparatus (ASN) and their families from returning to their hometowns.
This prohibition is contained in Menpan RB Circular Letter Number 41 of 2020. It contains restrictions on traveling outside the region and going home for ASN in an effort to prevent the spread of COVID-19 caused by the mobility of the population from one region to another in Indonesia.
"State Civil Servants and their families are prohibited from traveling outside the region and / or other homecoming activities until the territory of the Republic of Indonesia is declared clean from COVID-19," said Tjahjo as quoted by VOI, Wednesday, April 8.
However, if any ASN is forced to carry out homecoming activities for some reason, they must obtain permission from their respective superiors. Tjahjo asked civil servant development officials at ministries, agencies and regions to ensure that ASNs follow these rules.
"If any ASN violates these rules, then the person concerned will be given disciplinary sanctions as stipulated in Government Regulation Number 53 of 2010 concerning Civil Servant Discipline," said Tjahjo.
In Government Regulation Number 53 Year 2010, there are regulations regarding disciplinary penalties. Disciplinary penalty is a sanction imposed on ASN for violating regulations.
There are several disciplinary penalties that will be imposed on ASN depending on the level of error. The punishments ranged from verbal warning, written warning, demotion in structural positions, to dishonorable dismissal.
Other technical rules governing sanctions for ASN are Government Regulation Number 30 of 2019 concerning Civil Servant Performance Assessment, and Government Regulation Number 49 of 2018 concerning Government Employee Management with Work Agreements.
