Director General Of SPPR Asked To Check 263 HGB Certificates At Sea Fence Construction, Minister Nusron: Make Sure Inside Or Outside The Coastline
JAKARTA - Minister of ATR/BPN Nusron Wahid ordered the Director General of Land and Spatial Planning Survey (SPPR), Virgo Eresta Jaya to coordinate and check with the Geospatial Information Agency (BIG) regarding coastal problems in the Kohot Village area, Paku Haji District, Tangerang Regency.
This was conveyed by Nusron in response to the existence of 263 Building Use Rights (HGB) certificates and 17 SHM status fields in the sea fence construction area in Tangerang waters covering an area of 30 kilometers.
As for the details of the 263 certificates, namely on behalf of PT Intan Agung Makmur as many as 234 fields and on behalf of PT Cahaya Inti Sentosa as many as 20 fields. Then on behalf of individuals as many as 9 fields.
"Is the certificate of the field on the coastline or off the coastline? We have to check and we make sure. Because after we checked the documents, in the process of submitting the certificates, there were documents published in 1982. Therefore, we need to check which coastline is in 1982, which is the coastal limit in 1983, 1984, 1985 to the coastal limit in 2024 and until now," said Nusron at a press conference at the Ministry of ATR/BPN, Monday, January 20.
Nusron asked the Director General of SPPR to check the location in question in the map of the land parcel as stated in the SHGB and SHM. Whether it is on the coastline or off the coastline.
"And we ask that tomorrow there will be results. That's why the problem is not too difficult to see. So which coastline is it? We don't want to speculate first whether this used to be a pond or what form. We have the right to it, the benchmark is the coastline. If that's the coastline, the geospatial information has been proven, then everything will become clear. Which one is in the coastal line and which one is outside the coastline," said Nusron.
If from the results of coordination with BIG there are SHGB and SHM that are proven to be off the coastline, Nusron continued, his party will evaluate and review the certificate.

"So, we will certainly evaluate and of course we will review and we still have that authority because this certificate will be issued in 2023," he said.
"Based on PP, if during the certificate it is not 5 years old and it turns out that on the way it is proven that there are factually material defects, there are procedural defects, and there are legal defects, then we can cancel it and we can review it without having to process a court order. But if it is 5 years old, then a court order must be made," concluded Nusron.
