Without A Presidential Threshold, The PKB Legislator Calls The Candidate Regulations Can Be Created Through The Revision Of The Election Law

JAKARTA - Member of Commission II of the DPR RI from the PKB faction, Indrajaya, assessed that there needs to be provisions that limit presidential and vice presidential candidates after the abolition of the Presidential Threshold of at least 20 percent by the Constitutional Court (MK). According to Indra, the rules for the presidential candidacy still need to be regulated, for example, made through the revision of the Election Law.

"Even though there is no more PT, there must be provisions. For example, because the president will still be proposed by political parties, the requirements for the establishment of political parties must be carried out very strictly," said Indrajaya, Friday, January 3.

In addition, said Indrajaya, regulations can also be made through the revision of the Election Law which regulates the restrictions on political parties.

"For example, political parties that can carry a presidential/vice presidential candidate pair are political parties that have passed the minimum parliamentary threshold of 4 percent or political parties perched in Senayan," said Indra.

"It could also be that there are internal or inter-party conventions, and restrictions on the presidential election one round or two rounds like in the DKJ Pilkada," continued the PKB politician.

Other conditions that may be made, according to Indrajaya, for example, presidential or vice-presidential candidates must come from political party cadres and have been state officials. Like having been a member of the DPR RI, governor, minister or having led a political party.

The condition that captivates the 4 percent parliamentary threshold has proven to be effective in limiting political parties in Senayan. So non-parliamentary parties must be patient. Indra said there were several countries whose presidential elections were held without PT. On average, are countries that adhere to a presidential system, such as the United States, Brazil, Peru, Mexico, Colombia, and Kyrgyzstan.

Indra also believes that even though PT is abolished, not all political parties will nominate a president or vice president. "For example, PKS, even though it won the 2024 Legislative Election in Jakarta but could not propose its own cadres as a candidate for governor," he said.

According to him, if there are restrictions on candidacy only for political parties perched in Senayan, it is possible that at most there will be only four pairs of candidates.

"I am pessimistic that there are political parties that dare to carry their own presidential and vice presidential candidate packages," he said.
