Duel Rizieq Shihab Vs Bima Arya In East Jakarta District Court, Refly Harun: Rizieq Is Not A Criminal, There Are Many Political Dimensions

JAKARTA - Constitutional Law Expert Refly Harun is still questioning the motive behind the report that Bima Arya sent to Rizieq Shihab. As a public official, the Mayor of Bogor should be able to take a wiser alternative route.

"It can be a familial and administrative approach. If the hospital does not compromise, then the Bogor City Government will give administrative sanctions," Refly said on the Youtube channel @Refly Harun as quoted by VOI, Thursday, April 15.

Refly said, Bima Arya was not just someone because of the educational path he had taken. Bima Arya is a PhD graduate from the Australian National University in the field of Political Science.

"What does Bima Arya want to look for? Because I know, Bima Arya is a politician, an Australian doctoral scientist. I don't think he needs a publication, in 'cheap' quotes to boost his popularity, definitely not that," explained Refly.

For Refly, Rizieq Shihab is not a criminal whose existence endangers Bogor residents. When referring to the reason Bima Arya complained, this was solely to protect its citizens.

"I don't think Habib Rizieq is a criminal who if he is free he will endanger the citizens of the city. After all, he is also aware that when he gets infected with COVID, he is directly isolated and does not want people to meet him. Even if for example in his video he says something else, we must understand he is a celebrity who sometimes her medical records don't need to be published, "

"So this is not only a matter of itself (Rizieq Shihab COVID, red) but more political dimensions. So hopefully, Bima's testimony will not further exacerbate the punishment," said Refly.

During the trial at the East Jakarta District Court, Wednesday, April 14 yesterday, Bima Arya testified that information on the treatment of the defendant Rizieq Shihab was known through the Managing Director of Ummi Hospital Andi Tatat on Thursday, November 26, 2020. Bima then drove to the hospital to make sure no crowds occurred.

Still on the same day, Bima asked Andi Tatat to do a swab test with Rizieq Shihab. The reason is that Rizieq has had close contact with COVID-19 patients such as the Mayor of Depok, Mohammad Idris.

"I conveyed it to doctor Andi Tatat. And agreed to submit it for the PCR test," explained Bima.

On Friday, November 27, 2020, Bima received information that the high priest of the prohibited organization of the Islamic Defenders Front (FPI) had carried out PCR. He then contacted Andi Tatat to confirm

"Andi Tatat admitted that this was without coordination. I asked for the health protocol to be maintained. I admonished Andi Tatat, how could the hospital leadership not know what happened at the hospital," said Bima.

In the evening, Bima returned to the UMMI Hospital, met Rizieq and his son-in-law Muhammad Hanif Alatas. At that time, Rizieq emphasized that he did not want to be tested.

Continuing to Saturday, 28 November 2020 Bima Arya received a letter sent by Rizieq complete with a signature confirming the refusal to deliver the PCR results.

"I typed it, signed it, I got a photocopy of it. (The letter) was addressed to me," said Bima. From the information, Bima knew that it was the MER-C team that carried out the PCR test to Rizieq. Bima contacted the MER-C team to retest Rizieq.

Unfortunately, Bima's request was rejected outright. When summoned to the Police Criminal Investigation Unit on January 18 as a witness, Bima found out that Rizieq Shihab was confirmed positive for COVID-19. Rizieq's position has been confirmed since November 23.
