KPK: Officials And ASN Must Report Christmas And New Year's Gifts In 30 Days

JAKARTA - The Corruption Eradication Commission (KPK) said state civil servants (ASN), state administrators and officials have 30 working days to report if they receive gifts for Christmas and New Year's Day. They must refuse the granting of gratuities related to their positions.

"If an ASN, state administrator, and state officials have already received gratuities, which are related to positions and are contrary to their obligations or duties, they are required to report to the KPK no later than 30 working days from the date the gratuity is received," said KPK Spokesperson Team Budi Prasetyo to reporters in a written statement quoted Monday, December 23.

Budi said the report submitted to the KPK would be analyzed. "And it is determined whether it is a gratuity that is prohibited and belongs to the state or is a valid gratification received and belongs to the recipient," he said.

ASNs and officials can report their receipts in various ways, said Budi. For example, by coming directly to the anti-corruption commission office or submitting it to the Gratification Control Unit (UPG) in related agencies.

Meanwhile, the KPK has issued Circular Number 1636/GTF.00.02/01/03/2024 which is an affirmation of Circular Letter Number 6 of 2023 concerning Prevention of Corruption and Control of Gratification related to Hari Raya. Apart from not being allowed to accept, officials or ASN may not ask for gifts.

"In a circular it is clear that ASN, state administrators, and state officials are good role models for the community, so as not to make requests, gifts, and acceptance of gratuities in relation to positions or public services given to the community," he said.

"So rejecting the granting of gratuities is the first step in preventing corruption. Given that receiving gratuities can have a negative impact, such as causing conflicts of interest; contrary to regulations/ethics codes; to the risk of criminal sanctions," concluded Budi.
