Land Doubles Certificate In Medan Satria: Unrelented Legal Complexity
BEKASI A plot of land covering an area of 7,515 m2 in Pejuang Village, Medan Satria District, Bekasi City, became the center of a legal dispute involving three dimensions: civil, criminal, and administrative. This puzzling ownership status sparked a major legal risk for anyone involved, making it a "red zone" for investment.
PT Hasana Damai Putra's attorney, Fajar S. Kusumah, explained that the land was purchased by his client in 2010 through a legal sale and purchase process. However, the emergence of double certificates is the root of prolonged legal problems.
"We have strong evidence that shows that PT Hasana Damai Putra is the legal owner of the land through the legal sale and purchase process. This has also been strengthened through various levels of justice," Fajar said at a press conference in Bekasi, Wednesday, December 13.
Civil Conflict With Opposite Verdict
The dispute began with a civil conflict between PT Hasana Damai Putra and Rawi Susanto, et al. The two court decisions actually contradict each other: Decision Number 530 / Pdt.G / 2014 / PN.Bks stated that the land belonged to PT Hasana Damai Putra. And Decision Number 493 / Pdt.G / 2019 / PN.Bks said the land belonged to Rawi Susanto, et al.
Currently, this case is being tested through the Second Review at the Supreme Court with case number 1153 PK/PDT/2024. The Bekasi City Land Office is also a party to this dispute.
Complexity increases with criminal dimensions. Based on criminal decisions Number 1063/Pid.B/012/PN.Bks, the SHM 6116/Fighter certificate was issued using fake documents. The defendant, Drs. Arkadi, S.Sos, has been found guilty, confirming alleged administrative violations in the issuance of certificates.
"The impacts we experienced include material losses, business operational disruptions, and potential damage to the company's reputation that we have built for more than 40 years," explained Fajar.

This dispute makes the 7,515 m2-wide land an investment "red zone". The illegal process that has not been completed makes every transaction or transfer of land rights has the potential to carry a big legal risk.
"We are committed to taking all legal channels to defend the rights of the company. Our hope is a transparent, fair and dignified solution," added Fajar.
PT Hasana Damai Putra appealed to potential buyers and investors to temporarily avoid the land until the legal process was completed and ownership status became clear.
