Erick Thohir Regarding Allegations Of Conspiracy For High-speed Train Delivery Tender: We Will Study
JAKARTA - Minister of State-Owned Enterprises (BUMN) Erick Thohir admitted that he would study the alleged conspiracy in the tender for the delivery of the Jakarta-Bandung High Speed Train (KCJB) which was investigated by the Business Competition Supervisory Commission (KPPU).
The alleged conspiracy involved CRRC Sifang as part of the High-Speed Railway Contractor Consortium (HSRC) consortium with PT Anugerah Logistik Avisindo as the logistics officer who sent a series of trains aka electric multiple units (EMU) from Tanjung Priok Port to Tegalluar Depo.
Furthermore, Erick explained that the alleged conspiracy was aimed at vendors of PT Kereta Cepat Indonesia China (KCIC) with other vendors, not KCIC.
"For the KCIC, I am sure I will not abuse the tender process. Especially with my early tenure in 2019, I tried to check the priority program for justification of the Fast Train directly," said Erick at the Ministry of SOEs office, Jakarta, written Wednesday, December 18.
Even so, Erick said that in order to ensure that the entire KCIC operation runs with good governance, his party would further study the allegations expressed by the KPPU.
"But if the problem between the vendors needs to be studied, because there must be a legal umbrella, because this has a G2G," he said.
Regarding this case, Erick said that he had assigned the Deputy for Law and Law at the Ministry of SOEs, Robert Billitea, to conduct a study.
"Of course I don't want to talk in more detail, because I'll ask Mr. Robert Billitea, Deputy, to learn what the issue is. And KPPU is a good name," he said.
On the other hand, Erick said, since the launch of the Jakarta-Bandung High Speed Train (KCJB) or currently better known as
"Today, the Jakarta-Bandung high-speed train has been very successful, millions have been, even the trend to reach the break-even point in 2027 if I'm not mistaken according to the study, I think the expectations are great. So the use is very, very good," he said.
For your information, the EMU-Trafficking process will take place from September 2022 to June 2023 according to the schedule for EMU arrivals at Tanjung Priok Port. During that period, a total of 12 EMUs were transported in several batches to the Tegalluar Depo.
Allegedly Conspiracy For Shipping Tenders On High-speed Rail Projects
Previously, it was reported that the Business Competition Supervisory Commission (KPPU) found an alleged tender conspiracy on the Jakarta-Bandung high-speed rail project or known asminish involving a Chinese company, PT CRRC Sifang Indonesia.
Head of the Public Relations and Cooperation Bureau at the Secretariat General of KPPU Deswin Nur said investigators reported alleged violations (LDP) article 22 of Law Number 5 of 1999 related to Land Transportation Procurement for the Supply Unit (EMU) Supply Supply Supply in the Jakarta Project. Bandung High Speed Railways Project.
"In his LDP, the investigator suspects that there has been a conspiracy in the supply of train units for the Jakarta-Bandung high-speed rail project," he said in an official statement, quoted Monday, December 16.
Deswin said this case came from a public report involving PT CRRC Sifang Indonesia as Reported I (which is also a tender committee) and PT Anugerah Logistik Aktindo (ALP) as Reported II.
Furthermore, Deswin said investigators explained various facts or findings that led to conspiracy, such as Reported I which did not have standard written regulations related to the procedures for selecting goods and/or services providers.
Then, Reported Reported I also did not accept and/or open and/or evaluate the bidding documents openly or transparently, and Reported I won tender participants who did not meet the qualification requirements.
"Investigators suspect that Reported I has discriminated against and restricted tender participants to win Reported II," he said.
Deswin explained that according to the KPPU investigator, the reported party or ALP did not deserve to be the winner of the tender, because it did not meet the required paid-in capital, which amounted to Rp. 10 billion, and did not have similar experience or work experience related to the specified object, and did not get the highest score or score in the tender.
Allegedly, the conspiracy has hampered or closed opportunities for other participants to win the tender. For the record, the winner should be chosen by the tender method of Form Assessment, Qualification Assessment and Responsive Assessment," he said.
