Police Asked To Follow Prosecutor's Orders To Complete Files Related To Firli Bahuri's Case

JAKARTA - The filing in the extortion case that ensnared former KPK Chairman Firli Bahuri was highlighted. Police investigators were asked to follow the prosecutor to complete the file so that the investigation would no longer back down.

"The prosecutor's appointment needs to be examined against witnesses according to the Criminal Procedure Code, witnesses who see, hear, and experience themselves," said criminal law expert Romli Atmasamita in a statement quoted on Wednesday, November 27.

Romli assessed that the prosecutor's directive was appropriate to follow in order to provide legal certainty. Because a person is named a suspect, it should be based on two preliminary pieces of evidence that are sufficient in accordance with the standard operating of the procedural law.

Meanwhile, for Firli's case, Polda Metro Jaya investigators have examined 123 witnesses but none of them fulfilled the elements of Law Number 8 of 1981.

"Until now there is none. This means that Pak Firli's suspect status does not have sufficient evidence according to the prosecutor," he said.

Furthermore, Romli also highlighted the absence of two pieces of evidence that made this case file not received by the prosecutor. He said, this condition meant violating the human rights contained in Chapter 10a of the 1945 Constitution.

"That's called seizing a person's freedom of movement. With the status of a suspect, he is banned, it is forbidden to seize someone's freedom, among others, he cannot go anywhere, he cannot go abroad," said Romli.

Previously reported, the case file for the extortion case allegedly carried out by former KPK chairman Firli Bahuri had been returned by the prosecutor four times because it was deemed not to meet the material requirements. In fact, hundreds of witnesses have been examined.

As for Firli, investigators from Polda Metro Jaya will work on it again on Thursday, November 28. The investigation is planned to be carried out at the Bareskrim Polri Building, South Jakarta.

"So investigators have scheduled or scheduled an examination or request for additional information from the suspect FB on Thursday, November 28, 2024, at 10.00 WIB, in the examination room on the 6th floor of the Police Criminal Investigation Building," said Head of Public Relations of Polda Metro Jaya, Kombes Ade Ary Syam Indradi to reporters at the Metro Jaya Police Headquarters.

The former South Jakarta Metro Police Chief said that Firli's summons had been sent. "That's it on Wednesday, November 20," he concluded.

"Then, the summons for the suspect FB to be questioned on Thursday have been sent by investigators a few days ago, namely Wednesday, November 20, 2024," he concluded.
